My sister in law claimed her mom and her mom's boyfriend?
as a dependent on her tax refund because they don't work but draw social security and they live with her she wants to know will she recieve an additional 300 for dependants on the tax rebate or will her mom and her boyfriend get the 300 I told her I didn't think they would get an addtional 300 but I wasn't sure

Nobody will get the rebate for the mom and her boyfriend - the mom and bf won't get it because they are dependents, and your sis in law will only get her own - you don't get an additional rebate for dependents unless they are your qualifying children.

Depending on how much ss her mom and bf get, your sis in law needs to be very careful about claiming them as dependents - she would have to be able to prove she provided over half their support, and their ss counts as support they provide for themselves. SS doesn't count toward the income test for claiming someone, but it DOES count toward the support test.

They won't receive anything, other than your SIL. She'll receive between $300 and $600 depending upon her income and tax liability.

Dependents are not eligible for stimulus payments themselves.

The person claiming a dependent only receives a $300 payment for children under age 17.

Please ignore the posters who say she cannot claim her mother and her mother's boyfriend. If they both lived with her all year, had less than $3,400 in gross income each (excluding non-taxable Social Security), and she provided more than half of their support for the entire year (watch out for the Social Security here!) she CAN claim them as dependents. (In fact, her mother doesn't even have to live with her, though the mother's boyfriend does.)

Contrary to what some others have stated, you don't have to be related to claim someone as a Qualifying Relative. This is is a common error by folks who are not familiar with the Tax Code. See IRS Pub 501 for a full discussion on claiming dependents.

The parents receiving socal security will get three hundred each. At least they are supposed to. And your sister in law and family will get 1200, if they both work. You better tell her to save her refunds, the feds will be wanting it all back, when they realize she lied on her taxes. She can not claim the parents as dependentsm is she off her rocker. They both have money coming in.

she will not get the extra rebate for them, only dependants qualifying for the child tax credit (which means they would have had to be 17 or younger) also the mom and boyfriend wont get the 300 because they didnt file their own taxes and were claimed on another return. had your sister in law not claimed them they may have been able to file on their own even if not required and would have gotten the 300 depending on what type of social secuirty they received.

further on meeting the support test ...

"rent" is only permitted to be counted as far as reasonable and comparable rent ... if your sister-in-law has a large and/or luxurious house, the "rent" doesn't count. If mom and bf live together (as seems likely), that is one room out of many in the house.

utilities, etc. must be prorated just like in the office in the home deduction [number of rooms divided by total rooms, etc.]

similarly, food provided must be of reasonable quality, and not luxury.

as usual, records of spending are required, not estimates.


further, each person's support test must be separately passed, not the two of them together. [and without double counting the support]

frequently missed is the value of government supplied health insurance/care, which counts toward support the person provided himself. Medicare and Medicaid are worth an estimated 700 USD a month per person [better figures depend on knowing where this is].


the usual situation when both SS/SSI and Medixxxx are counted up is that no other family member has provided enough support to be able to claim them as dependents.

She won't get an extra but if she didn't claim and they filed on their own they would get 300 each.

If she is not suppose to claim them she should amend her retrun and let them file (even if they are not required to) so they can get the rebate

No, she won't get any "extra" money for them as I assume they are both over 17 years old.

And yes, both of them would qualify for the $300 each, I believe.

Edit: I was curious so I went to the IRS and downloaded their publication 501 for dependents/exemptions.

If either your mom, or her boyfriend, received more than $3400 in social security, they cannot be claimed as dependents.

Your brother may be in for a rude awakening when they have to pay back all the extra refund and are assessed penalties and interest.

Here is the link to the publication, print it off and show to your brother as if he signs the tax return, he is as guilty of fraud as your SIL

From what I've read, that 300 is for children as your dependents. I could be wrong if it is set up to were you are taking care of a parent. Also since they are all adults, then they all would get a tax rebate individually.

I also think that the parents have to do taxes, after all they are getting money from their SS, so they do have taxable income.

She has made a serious error, if not committed outright fraud. You cannot claim an adult as a dependent unless that person is disabled and you pay a third party for their medical care so that she can work. She cannot legally claim her mother or her mother's boyfriend unless she pays for their medical so that she can work.

She will not get the extra 300 that is meant for child dependents. They may get their own 600 each but they have to file their own returns to get it.

It's not a rebate ... it's an advance off next year's taxes. Hopefully she gets good refunds or she should put the money aside whatever she gets in May/June.

Each person can only be a dependent on one person's tax return, so if they are filing their own taxes, and claiming themselves as deductions, then they can't also be deductions on someone else's.

She will because more than 50% of their food and shelter comes from her.Social security is usually untaxable as it is indexed to inflation.Irs 1040 instructions can clear this up easily on IRS.gov.
