If you supported your self and your son then you can not be claimed as a dependent of another tax payer. Contact the IRS and report fraud. http://www.IRS.gov

If you can be claimed as a dependent of another tax payer they do not need to tell you they are claiming you. If you are their qualifying child or qualifying relative *(member of household is included and states you don't have to be a relative)*. If you didn't support yourself and someone else supported you through out the year and you lived with that person for more than 6 months that might be the case... Since the person is non-related to you it would have to be under qualifying relative which has a rule that YOU can not make more than 3,400 in the year. So that right there should be a give away..

You should know what case this is.......

Having a child doesn't automatically mean your a dependent.

This has happened to me before. You just file your taxes like you normally would. The IRS will send you a letter that someone has already claimed you & your son and that the burden of proof is on you to send. I sent them my children's school records, health insurance cards, my paycheck stubs, the bill for their private school that showed our address, etc. After about three months, they found in my favor and I received my tax refund. The person who claimed us initially was an estranged family member (we hadn't spoken in over fifteen years). The IRS did NOTHING to this person, they were allowed to keep their refund, they never went to jail, and I had to go through this crap every year for eight years always providing proof that no one else could claim me or my children. It only ended when this family member moved out of the country and was no longer filing taxes.

There are so many things that need to be known here for an accurate answer. The best thing you can do is to seek out a tax professional's help. They can take into consideration all of the things that are going on and advise you on how to proceed. I wouldn't trust too much what people here are going to tell you. There could be valid reasons why this person is trying to claim you.... You haven't given us any information like if you even KNOW the person....

If you file a return, go ahead and claim yourself and your son assuming you have the right to claim him.

If you don't file a return, you can notify the IRS - but how did you find out the person had claimed you?

File your return and claim yourselves as you normally would.

The IRS will send each of you letters, and the one with the proof that they are allowed the deductions will win.

The person who claimed you illegally will be required to reimburse the IRS and you will get the right to claim.

It will take some time for all this to get approved, so you need to file your return as soon as you can to start the process.

Did they pay for at least 50% of your living expenses in 2007? If not they can't claim you and you should report this to the IRS.
