Big momma | My son in law discovered that his employer hasn't been paying his Tax and NI contributions,what should he do? |
He recieved a letter from the DSS to say they had noticed he hadn't paid any contributions for over 20months and he approached his boss who said she would look into it but who has now admitted she hasn't been paying them as her business isnt doing to well.She has been stopping him tax&insurance of £130 on a wage of £400.Always in cash as she said she was going to sort out paying him in the bank.My son in law is very laid back and I am concerned and would like to know what he should do and what would happpen if he didnt report this. |

Right, firstly your son in law obviously has never been registered as an employee of her business otherwise HMRC would have been around asking questions (either that or something more sinister has gone on like she has advised them that he stopped working there.) Secondly, has she been giving him a payslip showing the deductions being made? He should encourage his employer to voluntarily approach HMRC. If she will not, he should contact them himself. If he has retained the payslips then he should not have to pay the primary national insurance contributions again - however even if he hasn't, it is normally up to the person who should have deducted tax from payments to make good this deliberate deception and defrauding of the public purse. Cash flow problems isn't an excuse! It isn't her money to retain! |

Your son-in-law should send copies of all his wage slips to the DSS to show the deductions have been made, even though his criminal boss has been pocketing the cash herself. He is in the clear. She, however, will be charged with fraud. Serves her bleedin well right. |

If he has pay slips and he is employed than I think that it is his employers problem - but I am not sure and suggest that your son in law gets professional advice ASAP. Good Luck |

If your son-in-law has proof of his deductions (eg payslips/form P60) he will probably be able to be given credit for his contributions, even though his employer hasn't paid them over. He should contact HM Revenue and Customs and the DSS for the matter to be sorted out. |

Your son in law can do 2 things. He can tell his boss to pay his NI contributions up to date and his income tax or he will be contacting the Inland Revenue about it. Or he can get in touch with the Inland revenue without telling his boss. He has to do something soon otherwise he will be liable to pay a tax demand in April from the Inland Revenue and all the NI contributions that are due to the DSS. What his boss has done is illegal and fraudulent. |

Thats illegal...and your son may have to pay it if her buisness folds....contact CAB asap...they will help you...or go directly to the tax office and report her.... |

Your son should call 0800 788 887. Thst helpline is for people to report their employer not paying over the tax & NI deductions to HMRC. They should be able to give him some advice on what to do. It may be worth him contacting the PAYE office which deals with that employer, as they may not have even set him up with the tax office. |

Your son in law must inform Inland revenue
Otherwise he could be seen as just as liable for knowing but not acting which is a criminal offence
if he informs them now they will do everything to protect him and his nat ins contrib. |

Have been through this myself. Contact HMRC asap send copies of payslips andand P60s and you will be fine. Any employer who does thi is really not one you want to be working for |
