You need to get this cleared up with the IRS ASAP. One of you will be required to repay what you received for this child. The IRS does compound penalties and interest daily.
Also, if you received Earned Income Credit for your son, the IRS could disqualify you from being able to receive it in future years.
There are too many consequences to filing what the IRS would consider a fraudulent return. |

It takes them up to 7 years to do the audits.
They will catch up to you eventually, and one of you will have to pay excessive fees and penalties.
You are better off disclosing right away. |

They probably didnt catch it. Don't be surprised if you get a tax bill in a year or 2. If its been 7 years Don't worry about it. |

The same thing happen to me I was claimed twice eventually It may catch up with you but sometimes it doesn't it never caught up to my filees yet. But one year my uncle claimed me and wasen't suppose to did I report him yes did it catch up with him no. So My advice is whoever has custody or if there is joint custody and there is any court documents envolved keep them all. Just in case it comes back to haunt you. |

They probably overlooked it. IF you get audited in the future, however, it could come back to haunt you. |

The have fixed that -- the income tax programs (H&R Block et al) all check it before it's filed.
Look for a correction until you hit the 7th year.. if they don't find it by then, you're in the clear. |

Not all tax returns are audited - only a fraction are. If your income was more than $100K then you would stand a higher chance of being audited - the IRS can't really afford to spend resources on all returns so it uses a cost-benefit approach which kind of eliminates lower income brackets unless your return ends up being the un/lucky one in its random audits. Best would be to correct the error asap. |
