Your marital status on Dec 31st determines how you can file. If you married in 2008, it would be presumed that you were Single on Dec 31st and therefore must file your 2007 tax returns as Single. (Of course if either of you were married to someone else on Dec 31st, things would be different.)

God forbid you get divorced in 2008 and don't remarry by 12/31, you can not file jointly for any of the year.
