My wife filed her taxes as 'head of household' not putting me on the return, am i entitled to half the refund?
i didnt work in the u.s. in 2007 my wife only worked for 3 months, but with the child tax credit the amount of the tax return was $3000 +....am i entitled to half the return if i am still married to her?....she got nothing back from her job just all of the money is from child tax credits...she claims i didnt work so i am not entitled to any of it.

Are you legally separated? If not, she wasn't entitled to claim Head of Household to begin with. To legally claim head of household you must be either unmarried or "considered unmarried" (legally separated).

She should file an amended return with the correct filing status (either married filing jointly or married filing separately). As to the refund you may or may not get, she isn't required to share it with you. Its technically her money.

Since she is married, she could only have filed as head of household if you did not live with her for the last 6 mos. of the year. If the children lived with her, and she supported them, then it is her refund and you are not entitled to anything. Legally you are not entitled to any of the money anyway, only if she felt like giving it to you.

I presume, you are separated, either legally or otherwise.

if legally separated, you have no "right" to any return. Traditionally, and from a fairness aspect, you have no "right" to the returns from her income anyway.

Also, I assume since you "didnt work in the US" you did work elsewhere and had an income? if so are you planning to share your return as well?

It sounds like since both of you are below the taxible income level that you need to focus on getting and maintaining a position, and not so much about how you're ex is treating you.

I wouldnt give you any. you didn't work, you didn't file your own tax return... what she filed for was HER income. Why should you get any?

What Bostianian said... she filed incorrectly if you're still meeting the criteria for a married couple. If you're living in Europe and working your income wouldn't count, but she still has to file a joint or married filing seperately return.

It doesn't sound like she is legally entitled to claim Head of Household status, since in order to do that (since you two are legally married) she must meet the following requirements:

To qualify for head of household status, you must be either unmarried or "considered unmarried" on the last day of the year. You are considered unmarried on the last day of the tax year if you meet all the following tests.

-- You file a separate return.

-- You paid more than half the cost of keeping up your home for the tax year.

-- Your spouse did not live in your home during the last 6 months of the tax year. Your spouse is considered to live in your home even if he or she is temporarily absent due to special circumstances. (See Temporary Absences, later).

-- Your home was the main home of your child, stepchild, or foster child for more than half the year. (See Home of qualifying person, later, for rules applying to a child's birth, death, or temporary absence during the year.)

-- You must be able to claim an exemption for the child.

So, it sounds like she didn't pay more than half the cost of keeping up the home, and it also seems like she might not meet that "lived alone for six months" requirement either, since it seems like your absence is only a temporary one.

In other words, she *may* have committed tax fraud. That, to me, is a much bigger problem than just whether or not she shares her refund with you.

If you were married at the end of 2007, she cannot file as head of household, she would have to file as married, so she needs to refile the taxes.
If you were legally seperated or divorced, then whether you have a right to the money depends on your divorce agreement, not tax law.

You don't give quite enough info to answer your issues, so I'll make some assumptions, and say what they are.

Your wife filed an illegal return by claiming head of household, unless you are separated and were since 6/30/07 at the latest, and she has a child of hers living with her.

No, you aren't entitled to any of her refund.

If you are a US citizen, then your income is taxable under US laws no matter where it was made.

Were you living together at any time in the last half of 2007? If so, she is not legally able to file as Head of Household. If that's the case she'll need to amend her return and either file a joint return with you or a separate return. If she files a separate return she'll have to pay back a good portion of the refund that she received.

On separate returns the other spouse has no legal entitlement to any of the refund, nor are the liable for any tax debt.

Edit: You still have to file a tax return if you are a US citizen or resident. Merely working in Europe doesn't get you off the hook for US tax laws.

Sure you are entitled half but I have found women have no dignity when it come to taking someone Else's money.

Good luck with that.

tell her that you will file also and claim the same thing casing an audit and she will then need to explain why she has not given you you half. If she is gullible she might go for it.

On the other hand if she has the kids then why would you get a child credit. Let her have it.
