My wife passed away in March but income taxes would I be able to do myself or should I seek a pro?

Of course you can go to a preparer. However, if you want to do it yourself:

1. Prepare your taxes as you always have, as a joint return.
2. If you use software, indicate that your spouse is deceased and the date of death if asked.
3. You can electronically file this return. If you mail in the return, in the place for your spouse's signature, put the words: filing as surviving spouse. No special forms need to be attached to the return.

In 2009 and 2010, if you are unmarried and have dependent child, you may qualify to file as a qualifying widower. After 2010, if you are not married, your status will be unmarried (single or head of household).

You can do it youself just as before. All you do is write "deceased" and the date of death on the top of the form and sign it as surviving spouse. You can still file as "married, filing joint". Other than the above you have to do nothing out of the ordinary. Good luck.

For this year, you can still file a joint return. You'll note on the return that she has passed away. If you usually use tax software, there will be a place to enter her date of death and the software will take care of the appropriate notations.

You might consider buying one of the good computer programs available as the very easily walk you through the process. I have used the H&R Block program and was pretty impressed with how it just walked you through by asking questions. The other brands look very similar and they will do state as well as federal returns, will print every form you need, and can even file electronically if you choose. If you do not have a PC that can handle these programs the local tax services should be pretty reasonable for a basic return. Many times your locally owned tax prep service will be just as reasonable as the chains plus they will take a more personal interest in you because they want to have you come back next year. The bottom line is that all the tax service use the same basic program that you can buy yourself at nearly any retail shopping outlet, (like WalMart).
You have my sympathy in losing your wife, it has to be tough and not something I like to think about but know I will face someday. Best of luck to you with your taxes and everything else.

I have been using tax act soft ware Tax act deluxe with the ur state tax bundle plus online filing of one return. The thing I have found about tax act is it has a menu of Life changing events. I am so sorry you lost your wife. This is definitely a life changing event you simply click on the event and the program takes you through the steps for that event. It also identify deductions that you may not be aware of that relate to a specific event. You stated in your question you do your own taxes then this program is like having a professional preparer with out the high cost

Your tax return should not be any more complicated than it was. You just have to identify your wife as being deceased and attach Form 1310 to the return if there is a refund due.

I'm sorry also for your loss.

I would ask your banker or bank manager for a name of a CPA they would recommend. You would just take 1/2 hour of their time and ask your questions. The consultation might end up being free if your appointment is from a referral.

Personally I don't think there is any special deductions, but the consultation may help you in preparing for your future taxes.

I think that your idea of going to a tax consultant/preparer is probably best as you have deductions that were not the normal .... and you may have inheritance taxes or some deductions that really need a pro.>>>>> I am sorry to learn that your wife passed .... please be cheered by good memories and thoughts of the years you two spent together and be comforted by her faith in you and your marriage. Note that you must file either as married filing jointly (for the year of death), single (for any year not prior to the year of death), or qualifying widower (for years immediately after the year of death). You are not allowed to file as married filing separately for any year ending on a day on which you did not have a living spouse. For the year of death, if you do not file as married filing jointly, there may be an obligation to file a second return for your wife as married filing separately. Additionally, a return for the estate may be required.

Jackson-Hewitt used to have a rule that they would prepare a return and then give you the option to have them file it (for a fee) or walk away, without paying. I am not sure if this is still the case. If they do still do business this way, you could prepare your return yourself, then go to J-H, see if they obtain a different result than you do, and then decide whether to pay to submit the return that they prepare, or to leave and submit the return that you prepared.

Always let a professional do this. They have ways of finding the little extras that regular folk overlook all the time. You've had a stressful enough year, let someone else help you with this one.

I would go to a professional just because they are usually current with the newest tax laws, etc. Just don't go to H & R Block.
