Dec 2008 is cutting it too close. Since you haven't mentioned the dates, the question would be :
Did she get a Paycheck dated in Dec 2008 ?
If the answer is yes, then she should also get a W2 by Jan 31st 2009 and she would definitely have to file her taxes for 2008. |

A non resident alien is required to file if their income is $3500 or more.
If you are married your choices for filing are MFJ and MFS, you can file with your wife.
Nonresident Spouse Treated as a Resident
If, at the end of your tax year, you are married and one spouse is a U.S. citizen or a resident alien and the other spouse is a nonresident alien, you can choose to treat the nonresident spouse as a U.S. resident. This includes situations in which one spouse is a nonresident alien at the beginning of the tax year, but a resident alien at the end of the year, and the other spouse is a nonresident alien at the end of the year.
If you make this choice, you and your spouse are treated for income tax purposes as residents for your entire tax year. Neither you nor your spouse can claim under any tax treaty not to be a U.S. resident. You are both taxed on worldwide income. You must file a joint income tax return for the year you make the choice, but you and your spouse can file joint or separate returns in later years.

Assuming that you are filing a joint return with her, you must include her income on that return.
If you are filing separate returns then her filing requirement depends upon her income. |

Dear Bol: You say your wife. In most situations you guys will file married filing jointly. You will add her income to yours.

Yes, if she has income in 2008, she will definitely have to file a return.
You may want to get some help from a CPA in preparing your return.
For tax preparation help, you could try the site below...I found it very helpful and they are extremely fast and friendly. They are CPA's but I think they moonlight and prepare taxes so they have "day jobs"...it's not like they are doing it for the money. They're just trying to help people out. Also, their rate can't be beat...last year, I paid something like $50 and they prepared my return for me and got me the refund fast. I didn't even have to do too much work...just sent them the forms I received in the mail (W-2, etc.) and I was done! |

Ask a tax expert, which i am not, but i am pretty sure you can list her as a dependent if you contributed greater than 50%(I am not sure about the percentage) of the total household income for 2008. So if she was living with you for the entirety of 2008, I'd image it'd be easier to file jointly and add her as a dependent.
But again, i am REALLY not sure about that. But it's something to look into. Also, if she wants to get a stimulus package in 2009, she will have to file a tax return. This is true even if she did not have to file at all (as I don't since SSI/SSDI is my primary income). |
