Yes, this is highly against the law. Both/Either of you could be prosecuted for it. Plus it means your friend is working illegally and the employer is liable as they did not check the names.

OK, this is bad.
You have commited a criminal offence; Defrauding the inland revenue, tax evasion, and allowing an illegal Alien to work in the UK without the correct Revenue clearance.
It is not too late.
First, foremost, and do it tommorrow - Get your friend to the local tax office or phone them up (Phonebook). They will just ask him a few Questions, and he will have a NI no. in no time.
I have employing EU nationals for YEARS and have never encountered strenuous delays. I have certainly never seen any situation where this level of Fraud is justifiable.
Now, the hard part; explain to HMRC what you did. Hope you get the person on a good day, and explain rationally that you made a bad, spur-of-the-moment choice, and you accept that it was not right. They may be lenient and not be too harsh.
From there, they will sort the mess out the best they can. |
