I just moved to the area (Lebanon, PA) and found out that a family down the road has a sign in their window for a hair salon.
The part of their house is set up like a real salon. Chair, sink, dryer, nail station, sitting area and powder room. Price list on the wall for cuts, color, etc. Also has hair supplies, nail polish and lotions for sale with price tags but does not have a official business.
Her clients come and make appointments like a business and she even offered to cut my families hair and has charged me like a salon but I made the check out to her, not a business. I found she doesnt pay taxes and does not have a real business.
Isnt that illegal in PA? I moved to PA recently and arent familiar with their laws but thought in home business or not, you report your income as any public job?? |

It is legal for a person to have a business in his or her name (it is called a sole proprietorship). Don't know if it violates some zoning restriction-you could check with the city hall to be sure.
I don't know, and neither do you probably, if she is reporting her income. She needs to. If she isn't, there are several ways she might get caught. |

Are you SURE the business is not listed as sole proprietor? If it is, then making the check out to her is legal.
However, it is considered a cash business and it is extremely difficult to prove if she is actually reporting every penny or not.
That is one advantage afforded to a home business that is in the name of the owner. Meaning if John Doe opened a home business called "I fix Computer" & it's registered as a sole proprietorship under his name, most likely the true LEGAL name of the business is "John Doe d/b/a I fix Computers" so writing the check to John Doe, I fix Computers OR John Doe d/b/a I Fix Computers are all legal. |

Yeas, she must report the income to the state and federal government. In addition, she may be violating local zoning laws unless she has received a zoning variance to operate a business in a residential area (easy enough to check). Obviously, a business license is also needed, and possibly some form of certification (I don't know PA laws, but in Maryland, a nail salon must be inspected by the health department). |

How did you "find out" she doesn't pay taxes? She probably is- on her individual return on a Schedule C. Just because you make the check out to her doesn't mean anything if she's running her business as a sole proprietor. And a business is still "real", even if the business itself isn't set up as a separate entity.
She's probably not doing anything illegal. A lot of people operate small businesses out of their homes. As long as they perform their business within certain bounds (and I know of dog groomers with similar set-ups that are allowed to operate in a residence) they can use their home legally. They pay the $50 or whatever it is in your city for a business license, and that's all they're required to do if they have to employees.
Unless she told you, flat-out, that she does not pay any taxes at all on the income she makes from her business, then she probably does. What you "found out" is probably just that the business, as a separate entity, doesn't pay taxes, because it's not set up that way. All of her income would go on a schedule "C", along with all of her expenses, etc. Your wages are reported on the face of your 1040, hers are just on a separate schedule.
Hope that explains the situation (obviously, I can't know for sure- she could be a tax-evading black-market back-alley salon operator. I just doubt it.) :0) |

You could always go to a beauty shop if you feel she is doing wrong. |

check the zoning for mixed used property. If that is ok then what she does is none of your concern but if it is solely residential then you can report her to the zoning commission |
