No federal tax law..?
Someone recently told me there is no law that says an american citizen must pay a Federal income tax. He also goes to claim that anyone imprisoned for not paying taxes is being illegally held.
I'm taking a business law class right now, and am under the impression that it is judicially impossible to hold someone in jail when no law has been broken...

So, is he right? and if so, what is the catch that he has to be avoiding?

This is often tried, but the IRS is quite clear on the matter.

The people that say the there is no law are called "Tax Protesters". Actually, the IRS has started calling them "Tax Deniers". While their theories vary, they all have one thing in common. Not one of them has ever gotten out of paying their taxes. They all end up broke and alone and many of them end up in jail.

Of course, he isn't. This has gone all the way to the Supreme Court. You can believe what you like. However, if you act on the belief that there's no law requiring US citizens to pay income tax, you will probably end up as one of those "illegally" held prisoners.

He is wrong and dangerously so. There are laws concerning federal income taxes and they are codified in Title 26 of the U.S. Code. Section 1 imposes a tax on the taxable income of individuals and families. Section 61, 62, and 63 define gross income, adjusted gross income and taxable income. Section 6012 defines who is required to file returns.

To see the tax laws passed by Congress, you have to look in the U.S. Statutes at Large. For the most part, these are not available online. However, you can read them at most law libraries and most Federal Depository Libraries. Perform a search on Federal Depository Libraries to find one in your state. Our current tax laws get their basic form from the Internal Revenue Act of 1954 and the Tax Reform Act of 1986. Various tax acts since that time have amended those two laws. The 1954 act can be found in Volume 68A on page 3. The 1986 act can be found in Volume 100 on page 2085.

You are correct that under most circumstances, it is impossible to hold someone in jail when no law has been broken. The only exceptions that I am talking about are those currently held at Gitmo. That is another issue beyond this current discussion. There is a simple and incontrovertible truth about our justice system. In order to be charged and tried for breaking a law, THERE MUST BE A LAW TO BE BROKEN. It is that simple. A person may be innocent and might not have actually broken the law, but in order to be charged with a crime, there must be a law making the act a crime. People who do not pay the taxes they owe and who do not file tax returns are breaking the law.

He is dangerously wrong. People (I could give you a list) have gone to jail for violating the Income tax law. Here is a link to the tax code www4.law.cornell.edu/uscode/26/ one of many on the Internet.

It is no use arguing with such people. Show them the law, they quibble that the 14th amendment or something wasn't ratified, or it only applies to married (or sometime single) people, or only applies to the state.

All of these arguments have been tried in court. All have failed.

I would get a different professor for business law, if possible.
