Overtime wages time and a half?
Does anyone know how many hours you have to work before overtime kicks in. My son's friend just told me his boss doesnt pay overtime unless he works over 88 hours. He gets paid every two weeks. I thought California law was 80 hours. Then OT

Anything over 40 hours per work week. How often you get paid is not a factor. If you get paid every 2 weeks and work 30 hours in the first week and 50 hours in the second week you'd be paid 70 hours of straight time and 10 hours of overtime.

California law requires that employers pay overtime, whether authorized or not, at the rate of one and one-half times the employee's regular rate of pay for all hours worked in excess of eight up to an including 12 hours in any workday, and for the first eight hours of work on the seventh consecutive day of work in a workweek, and double the employee's regular rate of pay for all hours worked in excess of 12 in any workday and for all hours worked in excess of eight on the seventh consecutive day of work in a workweek.

An employer can discipline an employee if he or she violates the employer’s policy of working overtime without the required authorization. However, California's wage and hour laws require that the employee be compensated for any hours he or she is "suffered or permitted to work, whether or not required to do so." California case law holds that "suffer or permit" means work the employer knew or should have known about. Thus, an employee cannot deliberately prevent the employer from obtaining knowledge of the unauthorized overtime worked, and come back later to claim recovery. The employer must have the opportunity to obey the law.

In most states, the law says overtime after 40 hours in a single week. Even if the employer pays for two weeks at a time, the 40 per week rule applies.

In CA, Overtime is anything after either 8 hours a day, or 40 hours a week [80 hours for two weeks]. The only way overtime is not owed is if you are on salary [and therefore, exempt], unless you knowingly signed a contract stating otherwise.

It sounds to me that this guys boss is trying to get one over on him. If his boss owns the business, chances are, he's screwing him out of more taxes, so that he can pay less; especially if its a service business [painting, construction, etc], as they tend to have more tax issues.

In Ohio over 40 hours a week. You get overtime. Check out the labor laws in your state. Obviously you have a computer

I'm not really sure about the California laws but in the State of Georgia it is time and a half after 40 hours unless you work on a farm or drive a truck. Sorry, I wasn't much help.

It depends. There is a law that controls whether you have to get paid overtime, and it depends on whether you are in the upper 1/3 or lower 2/3's of the paid employees. If you are in the upper 1/3rd, you can be considered salary and not receive any overtime pay at all - this doesn't mean that you have to be management.

The best way to find out is to file a complaint with the state of California with all of the facts.

Federal law - OT pay after 40 hours in a week. In California, there's an additional provision where OT pay usually is due after 8 hours in a day also. But in any case, 40 hours a week for anyone who is not exempt from OT laws.
