DigiBoy | P45: Can I claim I lost it? |
Dear all,
I am a very educated person, but unfortunately credit crunch has affected every position in the banking sector. However, I managed to get hired at Starbucks as a Barista. I am only worried for the following:
What would happen if I get an other job with my P45 form? I wouldn't like my employer to know that my previous employer was Starbucks. Would it be possible to say that I was working as a freelancer, or that there is no P45 form?
What can I do? Serious answers will be really appreciated.
Thank you in advance. |

Hi
The part of the P45 that you would give to a new employer will show your total pay and tax to date, and the PAYE reference of your previous employer - not the name of the employer.
It would be better for you to give your P45 to your new employer to make sure that you pay the correct amount of tax.
If you still don't want to: You could tell your new employer that your prev employer hasn't given you a P45, or they say they posted it but you didn't receive it (sounds a bit better than you loosing it!!!). They will need to get you to complete a form called P46, then if this is your only job at the time, they will use tax code 603L X. The 'x' means that they are operating the code on what is known as a 'week one' or 'month one' basis. There is a chance you will underpay tax, but it is more likely that you will overpay tax.
I assume that your job in the banking sector was well paid. If you received benefits that you no longer have (such as a company car), your tax code might be wrong. Call your tax office & asked them to check your code, they will apportion the car benefit for the amount of time you were with your employer during the tax year. This will increase your tax code so you will pay less tax.
If you start a new job will benefits again, remember to tell your tax office because your code will need changing again. |

As a former Employer, I can tell you this would have 2 effects:
1) your Employer's Accountant could find out when they try to link-up your PAYE record with HMRC, and you'd come out a liar
2) you could be dismissed for lying (or omitting information) on your application form.
Do not be afraid to have taken on humble work, on your applications you can bracket the qualification ("interim job, while looking for more meaningful work")
There is more honour in menial work than in lying to get a job... a decent Employer will appreciate this. What's more, sometimes having only worked in one type of role is not what Employers look for.
In applications, make sure you try to explain that you preferred humble, menial work to signing on the dole, and work it to your advantage...
"In this role I had to develop a range of skills, ranging from the ability to respond quickly and multi-task, while keeping an eye on Health & Safety, while still retaining a courteous, friendly and amiable customer-focus, for 8 hours at a time.
This shows resilience and willingness to muck in, if you are found to have lied, it will stand you in even worse stead, as your Employer will not give you a good reference, when s/he sacks you! |

What is the problem with an employer knowing you worked at Starbucks. To me it proves that you are willing to work to earn your keep and not sponge off the state.
Apart from that your next employer will not see your P45 until you have actually started the job.
And finally its nothing to be embarrassed about I would be proud to think I have managed to find a job of any type. |

You snob!
Your P45 will say your previous employer. Be grateful that you have a job and that you are not employed by GSK or Virgin Media.
Lying on your CV is a disciplinary offence. |

its your choice pay emergency tax or don't but as an ex employer if I found a employee had lied to me on an application form it would remove all trust with that person and I would have to consider wither to carry on their employment
employers want to se honesty and integrity.
Also employers are more interested to see a go getter (some one who will do what ever it takes for work wither starbucks or burger king) than someone who thinks they are too good for a certain kind of job
sorry if not the answer your looking for just being honest |

I would not tell lies as it can always catch up with you.
Be honest and say that you took "any job you could as the money was needed". That shows you are a hard worker and really were willing to do anything.
I would not be embarrassed just because you worked in starbucks for a while. You working there shows you are hard working and will try anything.
All you need to add to that is that you prefer banking but at the time there was nothing around suitable and you could not afford to be out of work. |

Your P45 will show your last employment details so if you do claim to have lost it, they will apply for a copy. Why are you worried about them finding out that you've previously worked for them? If nothing underhand was involved there shouldn't be a problem.

Just use a P46 instead.
Cheers for the thumbs down - this IS the form you would use. |

I'm not a tax/employment expert, but I don't think you'd get away with it. not just from your P45, but you'd need to prove your recent employment with references etc. it would probably show up somewhere on your tax record anyway. sorry |

you can, and it wont affect your new employment, but given your apparent previous financial experience, you should know that it will mean you will pay emergency tax until such time the inland revenue are happy about what you used to earn. The P45 speeds up this process. You could say that you worked in the financial arm of the company.... |

for someone so eduacted you are a bit slow, P46 if P45 isnt available, though a new employer isnt going to be at all bothered whats on your P45 if you can do the job. |

The secret of successful lying is stick to the truth as closely as possible. Keep a note for yourself of the figures on your P45, then shred or burn it so you really have "lost" it. It won't matter to the tax office - they have their own copy of it and will not be allowed to disclose to any other person who your employer was.
When you get another job your new employer will ask you to fill in a P46, and once the tax office link that form with your earlier records, your new employer will be given all NECESSARY figures from the P45 - but not Starbucks name etc. Meanwhile you might pay a little more tax than you should, but if so you'll get the excess back.
So your only remaining problem is what if a prospective new employer asks where you worked before. Be up front about working for Starbucks. Everyone expects bankers to be having a hard time at present, and one who gets up and gets a job rather than sitting at home will earn a lot of respect from a potential employer. Besides, a new employer might well want a reference, and the more recent the better. Resist the temptation to say you worked in Starbuck's finance department - the reference might mention that you were a very reliable barista!
DON'T say you were freelance/self employed etc. That could be shown to be a probable lie by anybody who knows anything much about PAYE procedures. |

Your form P45 parts 2&3 that you will give to a new employer won't show previous employer's name. If you don't give in P45, you will be put on emergency tax, and may have an underpayment/overpaymetat the end of the tax year. It could cause you a lot of bother with tax office to sort out.
I think your new employer would be impressed by you working at Starbucks. Someone who works in the same line of business all the time doesn't have such a rounded outlook on life, experience being education. It shows you aren't lazy, and show initiative. |

You do not have to give your new employer your P45. The only reason you can do this is to ensure you will be put on the correct code, which even if you are on the wrong code, you can claim back any money at the end of the tax year. |

yes u can it wont matter except u will be emergency taxed 20% of yr salary till its sorted out. if u say u have lost it yr employer shd ask u to fill in a p46 to send to the tax office. then its a case of u chasing the tax office to get a tax code asap. |
