so, i am 19 years old. I just got my W-2 in the mail and my mom will be filing for me. She stated to me that if she claims me dependant she'd get a bigger refund back and i would get less. however if I claim independant I will get the bigger refund back and she would get less. Im pretty sure she is going to claim me as dependant so she keep MY money that was supposed to go to ME- for herself. she claims that since I do not pay her for insurance, bills, cell phone, etc that she is entitled to keep the money I have worked all year for!!!!!!! that infuraites me, and I don't think it is right. should I let her claim me or what? |

Well, here are a few rules to determine whether your mother can legally still claim you as a dependent. Some, like relationship are obvious, so I won't mention them here.
1) are you in school full time? If not, and you are 19 years or older at the end of the tax year (December 31st), then she cannot claim you
2) How much support did she provide? If you provided more than 50% of your own support (and that includes rent, insurance, utilities, food, etc), then she cannot claim you as a dependent.
3) How long did you live with her? If you lived with her for less than 6 months, then she cannot claim you as a dependent.
If she doesn't pass these tests (all three need to be "yes"), then she can't claim you as a dependent child.
She could, however, claim you as a "qualifying relative", and if you made more than $3,400 last year, she can't do that either. |

NO....she is being selfish and greedy. IF you worked, you are entitled to a refund. Go to H&R Block NOW and have them do your taxes and file and single. You are over 18 and work, she is not supposed to do that. I hate that. Please tell me what happens. |

You lived under your parents roof for free the entire year letting your mom cover ALL of your bills and other expenses. Now here you are complaining how it isn't fair that she wants to claim you to get a bigger refund?
Know what I think? I think you're a spoiled brat.
Maybe this year you should pay ALL your own bills and other expenses rather than letting mommy pay them and help with household expenses. Then next year you would be entitled to the refund. |

Sorry, she is right. If she provides for at least 50% of your living expenses, insurance, housing, food, bills, etc she can claim you. She can keep claiming you until you reach 24 or get married. |

If you were not a full time student and you made more than $3400, then she CAN'T claim you.
If you were a full time student or made less than $3400, then the issue becomes whether or not you paid more than half of your own support. Your support INCLUDES the cost of living at home. Which includes the rent, utilities, food, insurance, the bills, the cell phone etc.
Why children think they pay all of their own bills when they don't constantly amazes me. |

If you make less than $6000 per year and have no kids it won't matter. You will get all the money you paid in back anyway. If you made more than 6000 or have a dependent then it would matter.
In order to be a dependent you have to have lived with the person. If you don't live with her and if you think the amount of money in question is enough to piss her off, tell her that she can't claim you since you don't live with her. |

Your mother can claim you as a dependent, but you can still file on your own, too. But.....if you your mother claims you, AND you file on your own, all you can get for yourself is the amount of federal withholding listed on your W-2. You would not qualify for the Earned Income Credit on your own return AND you have to check off the box that says "I can be claimed as a dependent on someone else's return"........ |

This is what happened with me and my kids. They were working , living under our roof, and not paying for anything. At 18 yrs. old, we agreed that we would claim them on our income tax, but after that it was their option. So, you have to think of your parents and what they do and have done for you, and how are they financially? You have the right to claim the income tax yourself, but if you do make sure you tell your parents that is what your going to do, so both of you;s don;t claim. Are you still in school? That is another factor to look at also. |

You have a couple of choices here...
1. Move out and support yourself 100% without any help from mommy.
OR
2. Be thankful your mom is letting you live at home still and don't argue with her about the deduction. I think she is entitled to it. She supports you. What are you doing to help her out? Sounds like she is footing the bill for just about everything you do.
