If your mother files first,you will need to mail your tax return claiming the children. The irs will investigate and give you the children. The parent has the higher right. You would get your refund faster if you were able to efile before she does.

If you are not married a joint return should not be filed.
If your boyfriend supports you, that is, provides more than half your support he can claim you. If he is the father of the children he can claim them as well.
If IRS questions this, you need to go to the local IRS office and explain what is and your mom will have her return corrected by IRS.

It depends on your age and the facts of the case.
If your Mom provided more than half of your support and more than half of your children's support, the deduction is hers.
If two people claim the same dependent the IRS won't be happy and they will let you know about it. |

She can't do that, and if she does you need to report her. Get your boyfriend to do his taxes asap, and then she will be the one to get in trouble.
I hope she don't have everyones SS numbers. Thats the only way she can claim you. |

How long did you live with each of them?
If you didn't live with your bf ALL year, he can't claim you. An unrelated person has to live with a person who claims them ALL year. If the kids are his biological kids though, he can probably claim them. But if they didn't live with him at least half of the year, he can only take an exemption and a child tax credit for them, not head of household, EIC or child care credit.
Depending on how long in 2008 you and the kids lived with your mom, she might or might not be able to claim them, and depending on how old you are and how much YOUR income for the year was, she might or might not be able to claim you. |

Whoever files their tax return second will receive a letter stating that the social security numbers presented have already been used or if filing electronically will receive a "rejected" status. If paper filing, IRS will more than likely ask for documentation, and he'll have to provide documentation to prove that the names listed on his return are really dependents as defined by the tax code. If electronically filing, the return may or may not process immediately. If it does process you may end up receiving a rejected status in a couple days. If you provide documentation that proved the dependents as correctly state on his return, then they may open a case on your mother return and ask for documentation. |

If either gets audited, they will have to show receipts that they are your primary support. that will include where you live, where you eat, etc.
they might both get in trouble. you could protect one of them, by authorizing one of them to count you as a dependent ( put it in writing for that person.) then, whoever doesn't have your permission gets in trouble. unless they aren't supporting you at all. |

the person who is responsible for the dependent care of the kids can claim them as a dependent.your Mom is wrong and you should stop having kids with boyfriends...MARRIAGE first then CHILDREN |

I would say that If your boyfriend files first before your mother and as long as the IRS accepts the return, Then you are in the gold. And when she goes to file, the IRS will reject the claim stating the Social security number is already been filed. I also you would be able to claim the Two of them with the EIC, and the third would be an additional child TAX credit. If she files before you, then you will have to report it to the IRS, and it will take a little longer to get that claim for the one child. But you have all the right as long as you provided the care for the child, then you deserve it. |

unless your millionares its highly unlikely you will be audited and both of them will get money back. if in the even they do check, they will find out who you live with and who your children live with and determine that that person gets the check |
