ok in 2006 i worked at mcdonalds for a year and a half and i never filed my w2 and then it got lost. i want to go ahead and file it this year so i went to my employer and they said they are a "privately owned buisness" and they arent sure if they still have it on file. if im not mistaken that sounds wrong right? she said even if they do have it it would take up to three months to get it? is that correct? is there any other way to obtain my w2?? please any help would be greatly appriciated. thanks guys |

Employers are required to keep this information indefinitely. They should (better) have it. No way it should take months to get it. You are just being slow walked. I suggest putting the request in writing and keep a copy. If you continue to get slow walked ask for the name and address of the actual owner. Write them, send it certified return receipt and keep a copy of the letter. |

1. Call the IRS and ask for a copy. The 2001-2006 data is on file.
2. You have to file 2006 income on a 2006 tax return. You can't add it to your 2007 income. |

Do you have your check stubs from 2006? (Probably not - kids don't keep anything.) If so, the last check stub should show year-to-date earnings. You could make an estimated tax payment to the IRS, stating that you had lost the W-2. They will take a good-faith effort to pay and work with you on the discrepancies. If not, the McDonalds does have your W-2. Pester them again and tell them you will need to talk to IRS about it. |

They are supposed to keep it, being a privately owned business doesn't excuse them from that - but you can also get it from the IRS. |

If you can not get copies of the Froms W-2 or a year end pay statement from your employer, call IRS at 800-829-1040 and request they send you an Information Returns Transcript which will have all your W-2s, 1099s or other information documents listed.
If you have a final pay statement for the year, you can get IRS Form 4852 and use it as a substitute W-2 |

Since you never filed, you'll have to get it from the employer, there is no other way. I hope you've learned a lesson from this mess. |
