Please help, we have serios IRS problems.?
Ok, I will not bother to go into the how this happened, but the IRS is now garnishing my wife's wages to the point to where we will not be able to pay the rent on our house. Whats worse is that she is an independent contractor as an insurance agent and they have it to where they are taking almost 75 percent of what she makes. They will not budge on this and now we really are hurting financially, which we were anyways because the economy has really hurt her business. And yes, I do work a regular 40 hour job and make decent money. They have as yet garnish my wages, but considering we live in California, and have 3 children, well lets just say it takes 2 incomes to make it here. I would love to here from anyone who has some good advice as to what to do. Is it worth going to one of the online companies that offer to stop wage garnishments or is that just a scam? PLEASE HELP! And please no comments like "just pay your taxes. Also, we owe more than 25,000.

Depending on the exact source of the tax lien, you may be able to get a "hardship" reduction of the payments.

Also, (thanks to the other answerers for reminding me), you may apply for an installment agreement. It's unlikely the IRS will approve one unless they get more money than they would have from the lien, but it can't hurt to try.

Also, under the circumstances, although credit card cash advances may have an interest rate over 24%, it might be wise to get a cash advance and pay off the IRS.

I don't KNOW for sure, but it seems VERY unlikely that any of those online companies will help.

No, don't go to one of those online companies - you'll just get scammed. But it might be worth talking to a CPA or maybe even better, and Enrolled Agent in your area to see if they have any suggestions.

OK. Our situation is similar. We live in CA, three kids, two incomes etc. We used our 401k funds to buy a house, yes I know a bad idea. We ended up losing the house, but the IRS is demanding 18k in taxes owed. We went to Tax Resolution Services in Encino (I think) and they totally scammed us. Initially, they told us that we qualified for the program where you pay pennies on the dollar. But once we sent them the $1500 down and then like 14 post dated checks for $300, all they did was assign our file to someone to set up installment payments to the IRS. WE COULD HAVE DONE THAT OURSELVES FOR FREE. We asked them to help us with the dimes on the dollars deal as we were lead to believe and they stuck us with someone who spoke very little english and in the end, we terminated the agreement, notified the IRS that they didn't represent us and placed stop payments on all the post dated checks. I felt absolutely scammed. We filed an Offer in Compromise ourselves, of course, turned down, but THERE is NO WAY we can afford installment payments on this now or in the near future. ( I was also an insurance agent). Right now, we are awaiting hearing from the IRS on what payment issues we can work out. They said that as long as you keep in touch with them, they will attempt to work with you. Funny, they were very nice on the phone and always answered the phone. However, the bottom line is that we cannot afford to have any garnishments as we are barely making it now. I'm sure people will tell you to go to a Tax Attorney, but that can be expensive.

miss angel is right. Fill out the collection information statement, gather up the last 90 days pay stubs and go to your closest IRS office to work out a payment plan. IRS will allow for necessary living expenses like estimated taxes, rent or house payments, utilities, food, clothing, medicine, car payments, gas, insurance, etc. They won't allow for unsecured loans, tuition, credit cards, etc.
IRS will release the levy as soon as you enter into an installment agreement with them.

Do not go online to find a company to help you. Check with your local Better Business Bureau and start with a member who abides by their standards.

You are going to have to get a second job or your wife will have to find one. You will have to cut back on any luxuries and keep your bills as low as possible. I know people who have gotten out of this debt by doing just that. It's hard but it does end, finally.

If the federal government is garnishing your wages, I don't know how some company could stop them. Don't be tempted. Go local, read every document, get them to walk you through exactly what they will do and what they will do if something doesn't work and get all promises in writing on the actual contract.

Do not use any of those "online" companies you're talking about - waste of money at best, disaster at worst. Get a tax attorney. You should have gotten one long before this! You might have been able to negotiate a settlement or straighten out the matter before it went this far. But now only a tax attorney can help you. Expensive, but you have no alternative.

It is not a scam. IRS will garnish wages when one ignores and doesn't make an effort to pay. IRS has been sending balance due notices and your wife decided not to reply or call.
anytime a balance is over 25K, wage garnish will happen. Did she ever provide IRS with and installment agreement request and make a monthly payment proposal? did she ever provide IRS with a Form 433-F Collection Information Statement? If she didn't then contact IRS at the phone number listed on the notices (she must call if it is only her debt) and work sometime out.

Try to make an "offer in compromise".

But, it may be too late, now that the IRS is already garnishing wages.

I think you have to sell the house, and move into the cheapest thing you can suffer through.
