Previous employor withholding W-2's?
My previous employor hasn't sent my W-2's. We had several payroll companies and has all of 2006 W-2's execpt Jan-March. In that time he cut me checks out of his personal account like I was paying taxes. He hasn't responded execpt to say I shouldn't claim that time period. Won't this mess up my taxes? And wouldn't I be exempting my refund on the taxes I paid for that time period? I believe he should reemburse me for the taxes and then 1099 me. Is this right? What can I do to make him give me my W-2's?

If by Feb 15th you have not received it, call the Internal Revenue Service at 1-800-829-1040 and file a W2 complaint. They wil take a report and send you a form that you can use as a subsitute, you will need your last paycheck stub when you call, along with the name, address and phone# of the employer and what dates you worked for them

Go on to www.irs.gov and see if they have advice. You have the right to report to the state that you haven't gotten your W-2 and your company can get fined from it.

Tell your previous employer that you need it to file your return. If he/she refuses then inform them that you will have not other recourse but to contact the IRS. How did the other payroll companies report your Y-T-D earnings? Somethings wrong here.

NY State Federal law states an employer must mail or distribute W2 forms by January 31st otherwise the employer will be in big trouble. Maybe you should look into this if you're not from NY

your right, he should reimburse you so you can fill out the other tax forms for other earned income and pay your taxes accordingly, but like the previous person says...you definately need to contact your local irs office and report his crooked butt... in all likelihood he is screwing many people over and if you don't report him it will end up being you who pays for his illegal activity
