Read the instructions for form 1040 at www.irs.gov EVERY YEAR under WHO MUST FILE. If you have no taxable income you do not have to file. Public assistance is not considered taxable income, but if the assistance is from other sources it may be taxable (like insurance companies)
Be advised that if you are on Social Services Public Assistance (welfare) then the state is providing more than 50% of the support of your children and another individual is not permted to take them as dependents (even if dad pays child support to the state, the state is assumed to be providing 100% of the support)
Every touchy subject with an auditor when they examine dad's returns, especially since he does not have custody of the children. |

You do not have to file. Welfare/public assistance is not included as taxable income. You cannot claim any EIC or child tax credit because they are based on earned income. Since you don't have any earned income, you'd get nothing back.
I was on assistance many years ago (hated it!) and never filed a return. As my case worker said, "It's not taxable." |

Generally there is a set amount of income that you are allowed to earn. I believe that you are exempt if you earn less than $5000. before you are required to pay taxes. Of course you should call the IRS or check out their newest publication or tax instruction booklet because since I've been working there the limit changes from time to time. Stay on the lookout for all your benefits such as child tax credit and any additional child tax credit. When you call the IRS they are required to answer your questions so have them written down and ready. Also remember to supply all of your income info if you have acquired any extra income that you may be in doubt of because tax fraud is getting serious! They will come after you...Just ask Wesley Snipes. They even come after their employees. |

The only time you need to fill out a tax form is if you owe money or want to get money back. If you do not have the minimum taxable income and nothing was withheld then there is no need to file. |

You should call the IRS and ask. There may be an allowance that you could get for your girls if you are the sole provider for them...which means you could get some money back...

You're not obligated to. But you should do it anyway, even though nothing will happen if you don't. Always best to play it safe. One day you might have a good income...you never know. You should at least fill out the form for your $300 or $400 that most people on public assistance get back at the end of the year. Call your office if you haven't received it. |
