Question about Taxes and a Student loan in default?
My student loan is in default (around $7000) I'm not working but I have gotten notices that they can garnish my wages or seize my tax refund. I'm planning on paying it off as soon as I go back to work because I want to go back to school, however I need my refund, is there anyway I can file without having my refund seized? does it matter that i'm married filing jointly? Can they take all of it, seeing as how over half is from my husbands income and he has no defaults against him?

call 1800 304 3107, this is the treasury offset hotline. You put in your ss# and it tells you if your refund will be offset.If there is an offset, there may be nothing you can do about it this year, but if u go into loan rehab you'll be able to protect futur refunds from being offset.

You need to submit a Form 8379 Injured spouse. The U.S. Dept. of "education" will steal your refund. You will get your portion of it back in 3 to 5 months. The IRS will "prorate" for you if you choose regarding you and your husband's income, deductions and credits.
Fortunately, it is easy to see if it is better for you and your husband to file Married Filing Separately. You just click the buttons in the software. If it is not financially advantageous, you should file jointly and fill out the Form 8379.
The U.S. dept. of evil will always steal your Federal income tax refund, but will not always steal your state income tax refund.
The U.S. Dept of evil has access to your employment records via your state employment agency. But, for some reason, it sometimes takes over a year for the agency to commence stealing your wages. I'm not sure if the portion is 15%. It is 15% when the agency steals social security "benefits".

Your husband can file an injured spouse form and they'll take only your share of the refund.

i would call sally mae or who ever you have the loan with and talk it out with them, perhaps you can go into forbarance since you are not working, and they can clear the default so you can file and get your refund.
you can also file an injured spouse form with your return, so they wont garnish your husbands part of the refund

all federal and state refunds or rebates will be taken for all offsets due for back taxes student loans and back child support until the bill is pay in full and if you have a wage garnishment they will do that also included in the refunds amonuts

yes they can and they will... it happened to my girlfriend last year...she didnt work at all but filed joINTLY with her husband they took her entire tax return..

They absolutely can take your whole refund. I have never seen or heard of anyone taking the whole thing...generally it is only a percentage. I would go talk to an expert...perhaps this year you can have your husband file seperately from you...whatever refund he may get they couldn't have.
