Question about filing taxes?
I'm married with a son. II was using taxslayer.com and clicked married filing jointly,... when I put my son's info. with mine and my husbands W2s our amount we're going to get back was alright. So I wanted to see if it would be more if we filed seperately. So I deleted his W2 and the amount was almost 3,000 more, but I realized i had forgot to select filing seperate instead of jointly.

Can i file jointly, but not add his w2? or do i have to add his?
It says more money if I say filing jointly, but don't add his W2, but it says less money if I do add his W2.
We don't owe taxes or anything either.

Both of your w-2s has to be filed one way or another. You either have to file seperately or jointly. You can't mysteriously forget to add one.

no you need to report all income and not leave anything out.. the reason for the difference is because your tax liability changed with the lesser income.. if you dont report it all you can get in serious trouble with the irs and risk them wanting to audit all returns from previous years

If you file jointly, you must include his W2. If you file seperate, he will be required to provide his income from a W2 on his return. You would need to complete 2 returns if you file seperately.

Married Filing Jointly

You can choose married filing jointly as your filing status if you are married and both you and your spouse agree to file a joint return. On a joint return, you report your combined income and deduct your combined allowable expenses. You can file a joint return even if one of you had no income or deductions.

If you and your spouse decide to file a joint return, your tax may be lower than your combined tax for the other filing statuses. Also, your standard deduction (if you do not itemize deductions) may be higher, and you may qualify for tax benefits that do not apply to other filing statuses.


WHO MUST FILE:

You must file a return if any of the following apply.

1. Your gross income was at least $5 and your spouse files a separate return and itemizes deductions.
2. Your unearned income was more than $850.
3. Your earned income was more than $5,350.
4. Your gross income was more than the larger of —
4a. $850, or
4b. Your earned income (up to $5,050) plus $300.

well if you filed seperately one of you could claim head of household and would get a larger return than the other. In certain cases I have seen where the sum of both returns actually came out higher than filing joint with one spouse filing seperate and the other filing HoH, but it is rare. Also if you live together then it is also illegal to file HoH

If you married filing jointly, both your w2's have to be used. the only way you can file, without using his w2 is Married filing seperately. his income has to be claimed somehow.

But since your claiming your son, when he files his taxes, he won't be able to claim you or your son and the chances are he will owe money.

If it was me, i would try the married filing jointly, then married filing seperately. (remember, he can't claim you, so i would figure out what he would owe, by filiing by himself, with no dependants) and go the best way. but all income has to be filed. If you file married seperately and he doesn't file. the irs will then audit BOTH of you down the road. When an employer send you a W-2 form, they also submit one to the IRS, so the IRS knows about that income, there is no getting around it.

It's almost always better to file MFJ rather than MFS. If you file jointly, you must include all W-2s received by either husband or wife. If you file separately, you are not eligible for all credits and generally have a higher tax liability. For example, you won't be eligible for EIC if you file separately. The IRS crosschecks W-2s issued and tax returns filed, so you will be found out and likely have penalties and interest as well as having to pay back refund received.

On a joint return you put in your and your souse's income. Do NOT put your son's income in. He has to file his own return.

If file separately from your husband you'll pay more in total taxes in most cases.

You usually get back more if you file jointly. Sure, YOUR return will be higher if you file seperately, but only one of you can use your son as a deduction, so your husband will probably end up paying.
