Question about the Economic Stimulus Package - I'm getting cheated out of mine!?
I'm 20, full time student, full time employee. I've been paying taxes since I started working 5 years ago. I live on my own.

However, my mom has to claim me as a dependent so that I can receive coverage under her health insurance.

She agreed to split her stimulus package with me because you get $300 extra for any dependents, and I'm not going to get squat because I AM a dependent.

However, she got her check today, $600, and it showed that she got no money for me because I'm over the age of 17.

So WTF, I don't get a stimulus payment for myself and my mom doesn't get one for me? I'm a taxpaying citizen! Is there any way around this?

I actually get health care *for free* paid for by my employer. My mom has asked that I stay on her health insurance as well, because once I get off of it, I cannot get back on, and I'm not sure how long I'll be with the company I'm at now.

It's not tax fraud for my mother to claim me, it's 100% legal to do as long as I'm a student, which I am.

My problem is that she's not getting any stimulus payment for me either. I'm not getting any money for myself, she's not getting any money for me. Is there not a way around this?

First, to the other responder, it's not tax fraud.

Second, to the poster, I'm in the same position as you! I work full time, go to school full time, and I'm 18. My mom claims me. I did not recieve any "stimulus" money, and my mom did not get any extra for me.

The problem is that you are over 18, therefore not a child. The rules of the stimulus package identify children as those under 18, not those who are still listed as dependents.

The reason you, youself do not get money is because your mother claims you as a dependent.

It really doesn't make sense, and it truly does screw a lot of people in our situations out of money they would put to good use. If the president really wanted the economy stimulated, people like us would get the biggest checks.

That's how the law was written, and there isn't a way around it.

Actually, if you live on your own, no it ISN'T legal for your mom to claim you if you are providing over half of your own support, or if you didn't live with her for over half the year. And she's also trying to scam her insurance too. But those are separate issues.

You probably are gettintg cheated out of it - but that's a consequence of you and your mom trying to cheat the insurance company.

You either ARE or you ARE NOT a dependent. This is a FACTUAL determination, not a choice.

As a full time student, the qualifying child test states that up until you are 24, income is not a test, but support is. If you did NOT support yourself, your mother CORRECTLY claimed you as a dependent. Since you did not support yourself, you were not entitled to the rebate.

If you DID support yourself, your mother made an error as she would NOT be entitled to claim you. If so, you both need to amend your taxes and she needs to get you off her health care PRONTO. Unfortunately, an amended return will not make you suddenly eligible for the rebate.

In my college days, the year I had a higher income from an internship, my dad and I sat down and *carefully* did the support test worksheet several times during the year. My dad was bound and determined to legally claim me as a dependent, even if I had to save half of my income to pull the math off. I could see the difference in his tax bill (dependent, education credit, etc), the access to healthcare and understood why it was worth ensuring that I didn't support myself.

They don't give a child credit unless the "child" is 17 or under. And you don't get one because your mom claimed you as a dependent. It sucks, but that's the way it works.

Honey, I'm in the same boat. I'm 23, graduated from college (just this month) and my mother has not paid a DIME for me in college. I am thousands of dollars in debt because I am not dependent on her, yet she still claimed me because I am currently living at home (and paying her rent and my own bills... I'm failing to see how I'm dependent). I'm not even on any of her health insurance policies, and haven't been for two years. Fun, huh? Not really.

No, there isn't a way around it. It is what it is. Maybe your mom will give you some anyway. That's really your only hope. But I say don't fret about it. What would you rather have? A $300-600 "stimulus" check or health coverage? Oh, and not to stir up any problems, but for the insurance packages I'm aware of and familiar with, the parent doesn't have to claim the child as a dependent in order to keep them on the insurance. Your mother will definitely benefit more by claiming you at the end of the tax year.

As already mentioned, being a dependent is not a choice you can make. If you provide more than half your support, you cannot be claimed by her as a dependent.

But real deal breaker is that you don't live with her. If you live on your own all the time, even when school is not in session, that she can't claim you as a dependent.

By the way, to say that she is not getting any money by claiming you as a dependent is not correct. Depending on her tax bracket, she's saving anywhere from $340 to over $800 on her taxes.

The way around it would be to support yourself. Your mom doesn't have to claim you on her taxes just because she wants to cover you on insurance. Your beef is with your mom, not the government.

I too doubt she should be claiming you for tax purposes and insurance because she isn't financially supporting you and you don't live with her.

Maybe she will pay you some hush money not to publicize to the world what she is doing.

You mom did not get extra for claiming you. And dependents will not get the rebate even if they file return. You may get when you file your 2008 tax return.

If you do not receive full amount of $600 now, then you may get the balance amount when you file your 2008 return, and you become eligible for the tax rebate.

Ok to all the idiots who think it's tax fraud...IT ISN'T!!!! If a parent has a child under i think 25 and they are still in school, they can still claim them...although when the child files their own they can't put a dependent...they have to put 0 when it ask for how many dependents... Before ya'll go and try and make people think they are doing something wrong how about you read up on it and actually know what the hell you are talking about. And unfortuantely you will not be getting a stimulus payment...I myself am in the same boat and I think it's a bunch of bull **** because we are still working and paying taxes, and just because we were claimed as a dependent doesn't mean jack ****...it should be that if the child is under 18 then the parents get it and if the child is 18 or over and claimed their own taxes then they get it...but the law is stupid and A LOT of people are getting screwed by this...probably 3/4 of the people still in school...and don't they know students will probably spend the money more than anyone else will...so I definately agree with you...it is messed up that we are COMPLETELY looked over...and to the other idiots...look your **** up before you judge someone and get your **** together

unfortunately there is no way around this, because your mom claims you(and she can as long as you are a full time student till age 24), the goverment assumes that she is supporting you and will not give you the rebate, although you do work full time and are getting health insurance through your mom so it's not all that bad, if you had to get insurance on you own, i guarantee you it would cost more that 600 a year

And you're complaining that you didn't get $300? How much do you think you'd have to pay if you were honest about your status and paid for your own health insurance? I guarantee it would cost you a lot more than $300 a year.
