EMMA R | Should i claim incapacity benefit? |
I left work due to bullying and am now on income support. I am finding it hard to make ends meet and really need to get back to work. The effects of the bullying, however, have hit me hard and i know i am not fit for work - i was suicidal over christmas. Should i claim incapacity, would i be any better off? I currently get £25 wk IS, due to child maintenance, and £100 wk child tax. Would maintenance still be taken off etc? |

You should definately try to claim IB but it is a lengthy process and they would want to see proof that you are trying to get better - e.g. antidepressants, counselling etc.
IB is taken into account for tax credit and IS purposes but the long term rate is around £95 per week. You should also be claiming housing benefit and council tax benefit to take care of your rent and c. tax. You would be entitled to claim this as a result of your entitlement to IS.
Furthermore, it might be worth applying for DLA if you have felt like this for three months or more. Although you would need doctors statements etc.
And lastly - put in a claim for compensation due to constructive dismissal from your place of work.

Edit - IB is NOT means tested, so no other income you have coming into the house, including maintenance will affect it, although it may affect other benefits you are entitled to. |

Incap is £61 per week and then it goes up after 6 months to 71 and again to 81.You need to get a sick note off your doctor and will probably have to attend a medical.I can understand how the effects of bullying have left you feeling that way.Bullies are nothing but cowards and you should not let them ruin your life.You obviously have a child so you therefore need to be there for him/her.Not only for your child but for yourself.If i am ever feeling low i always think of people who are in worse positions than my self and when i think about it i alway find how fortunate i really am.Don't let the bullies beat you.Try forget about them and move on.I know it's hard but you need to get yourself better for you and your child.Yes you should claim incap it's sounds like you are suffering from depression.I hope you get better soon.Take Care x |

IB is paid at a rate of £61 per week.......that is about £1.70 more than Income Support
Your child maintenance will be deducted from IB as it is IS
Your child tax credit will remain the same
The main difference between IS and IB is whilst on IS you do not have to undergo a medical and then fight for the benefit....
..........on IB you do.
Also as the government is trying to wipe out IB this year it is proving more and more of an obstacle to get
As you have children (and i guess as you are in receipt of IS you are also claiming as a single parent ) you would be better off staying on IS.....If you decide to move over to IB instead you will find a rollercoaster of payment delays, benefit appeals and medicals.....for the sake of an extra £1.70per week.....It really is not worth it |

Firstly to qualify for this benefit you have to get sick note from doctor every week for 28 weeks to send to the DSS after then they decide if you qualify and are sent for an independent medical which is very strict and if you qualify you get regular medicals but as you are on Income support you wont get much money, about £20pw and maintenance doesn't affect it. |

I think you should be able to get it. Talk to your doctor rather then the benefits agency, as they aren't known for their helpfulness and support. |

i'm in the wrong job.
i have always worked, i have always paid taxes, i pay my own medical costs, i often went home in a terrible state, crying, unable to speak to my parents, i used to cut myself, only hospitalised once though, i still couldn't claim any charity handouts even then.
you are lucky to have any support at all, having left your job voluntarily.
go for it, rip the system off for as much as you are able.
you are not alone, either in your bullying, depression, poverty, apathy, lethargy, or incapability.
good luck to you, and the millions of otherwise not so disabled claimants. |
