Should i claim my girlfriend and her kids on my taxes she never worked and i supported them. we split 12/05/07
she got caught cheating so i kicked her out. it had been going on for 5 months while i was paying for her school. that is where she met this guy. i dont want to be spiteful but she used me for 5 months while planning to move in with this guy. she said i could claim the kids if i split it with her but isnt it my right to claim them anyways. i have all their info. what should i do. what would u do. she lives with him now. cant he take care of her.

Assuming that her kids are not your kids you cannot claim her or them unless she agrees. The parent always has the right to the exemption if there is a disagreement. If she did not disagree, you could claim her and the kids as long as she did not earn as much as her personal exemption, but you do not have the right, she does.

You should have waited! Since you didn't live together ALL YEAR, you gave up the exemptions when you left or turfed her and the kids out. Her permission is meaningless; you cannot claim any of them.

You would have had to have lived together from 1/1/2007 - 12/31/2007 to claim the exemptions.

With taxes, there is no such thing as "close enough".

No, you didn't live together ALL year so even if you met all the other requirements to claim them, you couldn't because of that. So no you can NOT claim any of them.

As usual with questions on claiming dependents, you have gotten a number of wrong answers from people who don't have a clue as to what the law is, but insist on answering anyway.

it is not nescessarily your right, your situation will determine what to do. speak to a CPA

I think you could claim head of household if they were supported by you for at least 6 months out of the year. You have to provide SSNs for them, but I think you should and can claim them. Definitely ask a tax preparer before you do it.

I hope that by "girlfriend" you mean "ex-girlfriend"

It is your right to claim your kids, but it would also be very easy for you ex to screw you over if you did.
