Should i give my ex money from his intercepted tax refund that i will receive due to child support arrearages?
my ex owes over $10,000. in child support for my daughter. he's claiming her this year. he also has a son that he is able to claim. this is one of the few times in the past 13 years that he's worked and is filing taxes. he said that he has someone who is willing to claim his son for him and split the money with him (that way, he'll get some cash). he told me if i would give him $300. then he'll claim his son so that i'll get more money towards the child support. i feel like i want to do this just to get as much money owed as possible while he's working and paying. but, i also don't want him to "get over" on me and expect the same thing next time this comes up...although, i'm sure he will...but, i don't have to agree to it next time. what should i do?

the son is his...not mine. he's claiming our daughter because he has been paying child support. i won't be involved in the illegal scheme. he's basically saying that if i don't agree to give him $300., he'll participate in the illegal scheme. in which case, i won't get as much toward the arrears, since he would only be claiming one child. so, he's trying to bribe me. and, i don't want to give him money. i've just been owed the money for so long that it's almost worth the $300. to get a lot of that money that i'm owed. if he does just end up claiming my daughter, i'll probably only get 1/2 as much, and he'll get cash from his friend.

Don't do it! As someone above me already stated, what he's planning to do with his friend is tax fraud...illegal as hell.

I have a question for you...why aren't YOU claiming your daughter? My ex and I have been divorced for 13 years, we have two older teens. I have never let him claim them...here's why: a)both kids lived w/me more than 10 months out of the year, b) I remained single--so I only had my income to live off, and c) he and his new wife were both working in the medical field and making stupid money, yet he never seemed to remember to pay his child support on time.

No way was I going to do him any favors and I sure as heck would never let him try to talk me into some scheme such as your ex is planning.

Look out for your own best interests and those of your daughter. Now that he's working, you should be garnishing his wages for all that back child support.

Hunny, why would you do that, if he gets a return, the IRS will keep it from him, and send it to you. You get your money, but if you are caught up in his scheme then you bring a whole lot of trouble your way.

What he's proposing to do with his friend is tax fraud, and they can be in major trouble if they get caught which they very possibly will. If I were you I'd stay far clear of this scheme of his. Any anyway what's to stop him from taking your $300 and still doing the scheme with his "friend" - he sounds like just the kind of guy who would do something like that.

first of all are u aware that instead of u getting that money u rather give it to him even we know that they will OFFSET that refund cz of his back support for u. (whatever refund he will ever get they will totally deduct that from his back support)......just think about it... even u don't let him claim him...u will still get his refund AUTOMATICALLY......PLUS HIS BEING SMARTA55 TO U......cz he knows that if he claim his son........he will used that refund for him to LOWER his back support to u.....WHICH IS A BIG LOST FOR U.......ISN'T???

If he owes you money, why are you giving him some?

He needs to pay or get updated with his payments. the only thing he is doing is using you as a money changer. From his Taxes, to you hands and back to his pocket. Doesn't your child deserve to be financially supported?

Do you really need this headache..this guy has already proven that he is incredibly unreliable. What are you gonna tell the tax people if the bottom falls out of this plan. Don't do this. It is wrong from the start, I am not pleading the governments case, but you will be left holding the bag again. Have you learned nothing about this guy

If your son lives with you, although you can give your ex the exemption, NOBODY else can claim your son but your ex. He can NOT turn the exemption over to ANYONE else; that would be TAX FRAUD on his part.

I'm not sure what he's trying to pull. I'd just tell him that if he does not claim the child that you will and he can pound sand. His refund will be captured and turned over to you anyway so there's no reason for you to give him any money. He's pulling a fast one.

Edit: If your daughter lives with you, YOU claim the exemption, NOT him. The only exception to that is if you give him a Form 8332 or similar signed statement giving him permission to claim her. Tell him that he is not entitled to claim her without YOUR permission.

BTW, a court decree that gives him the exemption in exchange for child support is contrary to Federal law. The IRS is required to ignore such a decree.

I'd tell this bozo to put his "deal" in writing. He sounds dumb enough to do so. Once he does, file a fraud complaint with the IRS, using that as evidence. That should keep him hopping for a while.
