If you both work and make more than $3500 then you would each file separately. Whoever paid more than half the cost of maintaining your home should claim Head of Household and the other would file as Single. As for the children, the one who has the right to claim Head of Household must claim a child to do so.
Therefore, if your boyfriend pays more for the home he would normally claim the son and file Head of Household. Then you would file as Single and claim your daughter. He could not claim your daughter in most cases.
The other scenario is if one of the two of you had too much income to claim Earned Income Credit, it may be more beneficial for the one with the lower income to claim both children and get more refund due to a larger amount of Earned Income Credit.
It would be helpful for you both to see a good tax advisor to look at your whole household to see which ways would be better for you to file. You do have some good possible options.

You are not married and cannot file a joint return.
The one who pays more than half of the cost of maintaining your home may file as Head of Household if they claim the child you have together. The other must file as Single. If the one who paid less than half of the household costs claims both kids, both must file as Single. You'll have to figure all possible ways to see which way is the best over all. |

Too late. You have to be married by 12-31-08 to file as married.
What's stopping you from filing head of household with two kids? Both of you could also file with one kid each, one as single, the other as h of h. |

you'll can't file jointly since you'll aren't married.you can claim your daughter and head of household if you are head of the household that is and he could claim your son as his dependent only if he lived in the household with you'll and he supported him over 50% as single. |
