She was working at that time. She retired and has been on social security since 2003. Never filed a return since being on social security because her monthly payments are small--about $800 a month. I was gonna help her file this year so she would qualify for the $300 rebate. She has such a limited income that it would really help. But, if I do, is she likely to run into trouble with the IRS? |

I just filed for my mother (well, I sent it to her for signing as we do not live in the same state) and she'll send it in. While social security is never a tax deductible income, the instructions for the economic stimulus package state that filing for 2007 is required. If this is her only source of income, she would only have had to earn $3000 in Social Security benefits to qualify and based on $800 a month, she's golden.
Turbo Tax is free, but she or you will not be able to e-file as there is something that blocks it (so choose to print and mail). You can either go to www.turbotax.com and answer the simple questions for federal or print the 1040 A form off the IRS website and it will only require her full name, address, social security number and filing status (married, single...) and line 14a will contain the amount she received in ss for 2007. She can use the exact amount from the form that social security sent her (form 1099 SSA)...or as the instructions state, she can estimate the amount by taking her monthly payment x 12. They can pretty much prove her amount....so the exact number isn't necessary.
There's some confusion out there about waiting for the forms to come out before filing and that's simply not true. The actual flyer and brochure is on the irs website. There's also some opinions out there that you have to prove what you spent your money on. That's not true either. The money will not have to be reported as an income next year nor will your mom need to ever file again to report her ss payments.

The IRS operates on a "filing requirement." The filing requirement for single people doesn't look at social security earnings, so if that is all she has, she had no reason to file until now.
Fill out form 1040A, write stimulus package at the top, put the $9600 in 14A, have her sign and mail it in. |

I really feel your mother needs to contact the IRS and explain the situation, what she did and why, then ask their assistance in getting her taxes current (Sorry but H&R Block don't impress me - they "assisted" me for two years, and the third year I did my own, and found a mistake in the procedure for the two years H&R "helped" me. I filed amendment for the two years and got back $200). The IRS is pretty good at helping people with their tax problems. They want the records kept straight as much as "most" of the rest of us. Try IRS, I think you'll be pleasantly surprised! |

no, if she was entitled a refund the years that she didn't file, then the IRS usually calculates for her the years she didn't file, and send her the refund minus penalties for not filing. But if she owes the government money for the years she didn't file and worked, then they will send her a letter of offset due her rebate check..Either way they should send her a letter letting her know something as soon as she files. She can go back I believe 7 yrs to file. |

She has to file taxes if her income was over a certain amount per year...
If she didn't file taxes, she may run into trouble with the IRS and have to pay back taxes for those years plus interest that has incurred. It may not be worth the $300 check. |
