Should we feel obliged to pay a service charge?
I was recently at a resturant and after terrible service and a long wait for the main meal ( 1 hour) i refused to pay the 15% service charge.
the manager locked the doors to the resturant and told us we must pay. I just laughed at him and told him im now only going to pay £1 and left my address on a scrap of paper. As i left i had to tell him to open the doors or call the police! he paused then opened the doors.
Does anyone else have a story like this and do you pay the service charge regardless?

No, you don't have to pay the service charge.

luckily I have never been in this position, but you are perfectly entitled not to pay if the service wasn't up to scratch.

Why do service charges vary?
It is up to each business whether they make the service charge compulsory or optional and what percentage to levy.

Do you have to pay it?
A business that adds a service charge must state this in a prominent place – on the menu, or on a sign on the wall, for example – where you can see it before you make your order. If this has been done then you are obliged to pay it, unless service has been really exceptionally bad.

What if the service is poor?
If a problem with service does arise – there is a long delay between courses, say – you should alert the management to it as soon as possible and give them a chance to put things right.

The last resort?
If alterting the staff or management to a problem with the service does not solve the problem, you can in theory withhold a suitable proportion of the service charge (though the proportion is hard to quantify). Alternatively, you can pay the service charge ‘under protest’ with the intention of claiming it back later in the courts – something you must state in writing at the time. But you should bear in mind this could take six to nine months and a court hearing – so it’s definitely best to resolve the situation some other way.

I have not been to a restaurant that has service charges.If the service is good I leave a tip if bad they get nothing.Good for you sticking to your guns.

Same in OZ, you only pay if the service is good. I can understand the USA because they underpay their staff.
I wouldn't have paid the pound myself.
Great to see someone standing up to these modern day want to be Robin Hoods.

This is a sure sign that the waiters don't get the so called service charge the restaurant pockets it.
Why not name the place so we can avoid it?
I stayed in a hotel at Heathrow Airport and the breakfast cost £15. They added 15% service charge for this. I complained because it was a self service buffet breakfast & they took it off without any fuss, but I won't stay there again.

I refuse to go to restaurants that add a mandatory service charge. I am paying for the food, and will leave a tip dependent on the quality of service. If it is good, I have no problem leaving the waiter 20% but will not be forced to pay extra for bad service.

wow that sucks in america you have a choice to tip the waitress or waiter. i've left a resturant twice without paying a tip (service charge) and i felt good about it, i believe that a waitress or waiter has to earn their tip. and if i feel they didnt earn it then i dont tip them, good for you.

If this service charge was clearly marked on the menu then really you should have paid it . Where I agree with you is that these charges should not be automatically charged , they should be at the customers discretion and staff should not be relying on tips to make up their wages
I assume he has just written you off as a tricky customer , and no doubt you will be taking your custom elsewhere in future
But well done for making a stand , if service or quality of food is poor I agree you should have the right to withhold this 15%

If the service charge was described as being “optional” or “discretional” then that says it all. You can opt not to pay it regardless of whatever the service is like.

No, you should never feel obliged. I don't tip no matter how good the service is. If nobody tipped, then restaurant owners and other slave-drivers would be forced to pay a decent wage. I never go to the same place twice, either.

they shouldn't make you pay service charge and don't have a right to make you pay. were there other people in the restraint? if there was what did they think about the situation? i went over to america in august and we refused to pay the service charge because it was bad service they brought out our main meals when half our party hadn't finished there starters and we were not happy because we felt like they were trying to rush us but luckily ive never been in your situation.
