~G~ | Should we file married or married but separate or single? |
I have only been married since the end of August, and my husband thinks it would be better if we filed as married. But he has two disability lawsuit checks to claim( both total under 6 G total) . And he thinks he is going to have to pay. I think it would be better to file married but separate, because I bring in with my job is considered poverty level and I have a child. I think that this way I could get earned income credit and claim my son.

You absolutely cannot file single. In no circumstances. You lose the earned income credit if you file separately. Depending on your combined income you may lose it anyway. You also lose child tax credits if you file mfs. You can do your return married joint and do married separate and see what turns out best. It also depends on what state you are in. If you are in CA it is a community property state. You have to add both your incomes together and divide by 2 if you file separate. Might as well file joint. |

Your choices are a joint return, or married filing separately. On a MFS return no EIC is allowed, so you can't file a separate return and get EIC for your child. |

You would have to try both methods but generally, you are usually in better shape if you file jointly. Separate returns are usually the most costly and neither of you can file as single. |

I would file married filing jointly. If his are under 12 grand, then that isnt' going to make much difference on the taxes. Depending on where you are on the poverty level, then decide. Figure your taxes both ways, and whichever is best, then do. YOu can make quite a bit and still get eic. I don't remember but I think it is around the $40,000's or more.
When I was seperated from my ex, we filed married filing seperately and I qualified for the EIC. And I got it. I wasn't legally seperated either. Did this for 3 years. Even had taxes done by a professional one of these years, and wasn't told I was unable to get it. I also got the child tax credits. |

Well, check our turbo tax this year, input all of your information and then make the change to see how each one effects you.
For us, joint works best... but you have a total of three choices.... joint, head of household and married filing separate. |

I would suggest TurboTax or some similar tax program, run the numbers both ways and see which way is best for your situation. |

You should probably file Married Filing Jointly. If you file Married Filing Separately, you are barred from claiming the EIC.
Don't worry about the disability claims triggering any tax. In nearly all cases there will not be any tax due on the disability claims. The only case where a disability claim is taxable is when the employer pays for the disability coverage or where the employee pays for it with pre-tax dollars. Both are unusual situations. And if the disability is paid either by Social Security or a State Disability system, in most cases it's not taxable on a joint return. Social Security Disability on a separate return IS taxable though so you really do want to file jointly in nearly all cases. |
