APS | Should we file our taxes together or separately? |
I am an unwed, unemployed mother of one. My boyfriend told me that I would get back around $3,000 for my tax refund. (He said that I would get a pretty big tax return because I have a dependent. He thinks he knows everything about filing because he and his ex-wife filed together and got a lot of money.) Later, he suggested that we filed together because we'd get a bigger tax return. I did not know that we could even file together, and I am not convinced that we can even do that. I actually prefer that we file separately. Can anyone give me any clear facts about filing taxes particular to my situation? |

Since you aren't married to each other, you aren't allowed to file a joint return, so there isn't any decision for you to make on that. You'll file as single. But if you were unemployed all year, there isn't anything to give you a refund.
The EARNED income credit requires that you have .... earned income. |

No you can't file a joint return with your boyfriend, unless you get married by 12/31/2008. Go ahead and file "Head of Household" to take advantage of the Earned Income Credit. |

If you are unemployed, unwed and have one child you have no requirement to file a return; and nothing to file a return on as you would receive no refund whatsoever anyway. You are wise, however, to not be listening to "they" and "them". I have been doing taxes for 37 years and spend a lot of time getting people out of hot water who listen to "them" riding a barstool or something. If you BF is single and has provided your support and support for your child for the entire year then he can take your dependency and your child's dependency on his return entirely legally. Hit me with an questions you have if you want any clarification. |

If you marry no later then December 31, then you may file jointly for the entire year (including the portion before you married).
If you remain unmarried for the remainder of the year, then you are not allowed to file jointly. |

If you made $3500 or more, you can't be claimed as a dependent.
If you aren't a dependent, you are the only person who can claim your child. You would file as single.
He's not married and this isn't his child, so he files as single.
PS, if you happen to be in one of the few states that recognize common law marriage, once you put forth that you are married, you can't separate without a divorce. |

It is generally true that when you file together (jointly) that you stand the chance of getting a bigger refund. However there is something else to consider when filing together (jointly). If one spouse earns a lot of money and the other spouse earns very little and the two file jointly then whatever tax liability the couple has would be the responsibility of each spouse. For instance, if married, and one spouse earned $100,000 and the other spouse earned $0 and jointly they had a $14,000 tax liability and then they got divorced (or even if they didn't) then each spouse would be responsible for the entire $14,000 in the eyes of the IRS. One more thing, you must be married in order to file jointly. I hope this helps. See the link below to the IRS website about filing status. |

Always wondered how an unwed, unemployed person with child maintained a household. How is food provided? Rent?
Transportation?
If the answer is "the boyfriend" he can take you as a dependent but not the child. Only you can claim the child, unless your parents provide more than half the childs support; then they can claim the child as a dependent. |

If you are not legally married then you cannot file a joint return. sounds like your boyfriend does not know about taxes. You say you have a dependent, if you provided all expenses then you can file as Head of Household. that will give you a better refund. |

If you get married before the end of the year, then yes, you can file together. Otherwise, you'll need to file alone. I'm really unsure about "getting more" if you file together. In most cases, you actually get less by filing jointly, aka the marriage penalty. Maybe he figures HE'LL get back more if you file together, because then he'll be entitled to 1/2 your return? Unwed and unemployed, yes, you probably qualify for the Earned Income Credit. Don't forget to file Head of Household. |
