Single member LLC and Tax?
Hi

I am working as sole proprietor but planning to open a single member LLC .

I have below questions.

1) As sole proprietor you file Schedule C and for SMLLC also I need to file Schedule C but for example if you don't have any business any year do I still need to file taxes for single member LC or NOT ?

As sole proprietor if you don't have business then you don't file schedules C but will same rule apply to Single person LLC.

A single member LLC (SLLC) is considered a disregard entity, therefore that member would file a Schedule C listing the LLC's name as the business name along with its Fed ID#.

For all intents and purposes, a SMLLC IS a sole proprietorship, which now has the limited liability protection aspect of a corporation. If creditors want to seize your assets due to poor business operations, it can only take whatever is in the business and NOT your personal assets, hence the LLC protection.

Be careful as NOT ALL states recognize LLCs in the same manner and some states tax LLC's as a Corporation!

you can file a LLC in one of three ways, sole proprietor, corp, or partnership
since forming an LLC costs about $1500 and you haven't decided yet how you plan to operate this, why not just continue as your Sch C, forget the LLC business, if you are worried about liaiblity, get an umbrella policy, $1m for $325 /yr, at least you don't have to pay the annual tax on the LLC regardless of what it does
if you get an LLC registered, yes you will file each year regardless of activity
