Someone has claimed my son for the 2007 tax year! How do I find out what's going on?
My returns were rejected saying that my son has already been claimed. The IRS advices to mail my returns and when they process them in 4-6 weeks I will get a letter advising I have to prove my legal rights to claim him. That's all well and good (I mean it sucks but I can do that) but I want to know WHO claimed him--is this identity theft or a miskeying on someone's part or right out fraud by someone who has access to his SS#?! How can I find that out, the IRS acted like it wouldn't be any of my concern! I want to press charges or something, I am sooo frantic that someone has my child's information, I don't know what to do! HELP PLEASE! THANKS!

Additional info as requested: my sons father does not have his info; even if he did he is incarcerated so i'm thinking he wouldn't be filing taxes. I am just at a loss; I could cry!

The IRS is prohibited by law from telling you WHO claimed him, just that someone did.

It probably isn't just a simple miskeying of the social security number by the other person - if it was, THEIR return would have rejected, because the name and number wouldn't have matched.

You might be able to pull your son's credit report - try annualcreditreport.com - that's the free site. But there probably isn't one on him if he's only 7.

I can understand you are frustrated at having this happen, and having to wait for your refund. But there's no real way around it other than waiting.

You can file a tax return with the person as a dependent but not by computer since the social security number has already been used. Complete a paper return claiming your son and mail it in.
The IRS will look at the rules of dependents and decide who has the right to claim the person.
IF the IRS decides in your favor the other person will have to pay back part of the refund, possibly with some penalty and interest.
it will take three or four months for them to process your return and make a decision.

It would hard to for the IRS to prove that person intended to file an incorrect return so they would not likely refer it to the justice department for prosecution.
So if the other person lost the dependent they would have to return some of the refund with penalty and interest as I said before.

Call a lawyer for advice ! Good luck on finding out i don't blame you on being upset because your child is probably with you 24/7 right ! Did you ask your Ex about it?

The IRS will *never* tell you -- and that's a good thing. It's reassuring to know that they won't give out anyone's information to any other person, regardless of how good the reason may sound.

What they will do, however, is investigate the situation thoroughly, and if it's as clear-cut as you describe, they *will* prosecute the person who was fraudulently trying to claim your son without reason. You don't need to press charges yourself -- if something illegal has happened, the IRS will take care of doing that.

Speaking of that, though -- have you considered that the boy's other parent might be the one who's claiming him? Have you spoken to that person and asked them? Could their claim possibly be legitimate?

Last year when my husband and I e-filed, we also have dependents, the preparer rec'd a response that my husband's social had already been used. I am unsure what actually happened, assumably the other party that made a mistake and put their number in as my husband's was caught because it did not escalate to your situation, but we just rec'd our direct deposit refund a week later. I had our credit bureaus pulled after that too just make sure no one else was actully using his social. The IRS won't tell you who else used his social. I know you were really looking forward to the refund and this delay is very upsetting, but all you can do now is do what the IRS asks and in the end it will work out as you rightfully should have claimed him, with that social security number.

it sucks when this happens, but they cannot release the identity of the person who claimed your son. it is against the law to release that info. you would have to let them pursue and report them if they decide to do it. most of the time the irs will tell the person dont do it again. its sad but it happens all the time.

contact the irs again. a lot of times this federal agency gets a bad rap. more often than not they really are a pretty reasonable bunch. i think you will find out from someone over there if they cant do it they will direct you to someone who will. good luck bob

DEFINATELY DO as they ask!
They're not a excitible as you are....and 'you' have every DAMNED reason to be. They could be just WAITING for your proof, which I don't doubt....just to NAIL the person that has done such a thing!
It may go beyond identity theft....but, come on, they'd have to be CRAZY to claim your Son? Do yhey have your same 'surname', claim him as Adopted?
Have you checked with your Parents, Brothers, Sisters a Divorced or Separated from Husband, who gives you 'child support?
I'm sure ,in time. all your answers will come out!!

well i think that the IRS doesnt do anything about that because i have all ready 4 years that someone else have been filing taxes with my son ss. all 4 years send them proof that thats my son and they still giving that other person my money because it happen to me this year again. they give me my money back late but they give it to me. i dont feel like its fare that they keep on letting that person do that to me. i want to know what could i do about it
