Someone told us that she could claim her child that only lived 10 hours on her taxes. Is this true?

Apparently yes you can claim a child who was born alive even if it live for only a few moments, because this child would have been considered to have lived with you for the entire duration of its life.

They do not use a social security # but birth and death certificates ( the child would have both)

This is from the IRS itself...
Child born alive. You may be able to claim an exemption for a child who was born alive during the year, even if the child lived only for a moment. State or local law must treat the child as having been born alive. There must be proof of a live birth shown by an official document, such as a birth certificate. The child must be your qualifying child or qualifying relative, and all the other tests to claim an exemption for a dependent must be met.

Yes, she can claim the child. Because the child was born alive, the IRS allows her to claim the baby. She only needs to have proof (like a birth certificate) that the child was born alive. Publication 501 on IRS website

Yes, it is true. A child who is born or dies during the year is exempted from the usual 6 month residency rule. A child who is born live and dies even a moment later is considered a dependent for the entire year.

There is an exception to the SSN rule as well in this case. An SSN is NOT required, although the SSA will issue one if you apply for it. Here's what IRS Pub 501 says on that issue:

"Born and died in 2007. If your child was born and died in 2007, and you do not have an SSN for the child, you may attach a copy of the child’s birth certificate instead. If you do, enter “DIED” in column (2) of line 6c of your Form 1040 or Form 1040A."

Those who are referring to the 6 month rule or the SSN rule have obviously NOT read IRS Pub 501 on this specific issue. Their answers are WRONG! This is a CLASSIC example of folks shooting off their mouths without knowing what they are talking about. I've even received some "Hate Mail" from some of these morons!

How could there have been so many "No" responses when the answer is absolutely "Yes."

You really have to be careful about information you receive from these web sites -- most people "think that they know" rather than "know that they know."

Absolutely true. As long as the baby was born alive, that child can be claimed for the year even if they only lived for a minute or less.

I was also told that you can claim a deceased child on your taxes I just wasn't sure how. So, I just wanted to say thanks to those of you who answered this question for I am in the same boat. My tax guy told me to get a SSN anyway because me son in entitled to it but I don't want it falling into the wrong hands. The information has been very helpful. I also did not want to deal with the SS office again. I was already told how to file for my son but this has set in stone for us. Do you need to provide a death cert too? I was told that you do not, just need the birth cert.

Please call the IRS at 800-829-1040 and ask them directly. It's definitely worth your time to inquire.

If she has a Birth Certificate for it and obtains a Social Security number for it, then yes, she can claim the child on her taxes

I don't see how she could do this, as the child would need a social security number. And to spider87, a child does not have to live with you for 6 months if it was born the year you are filing. My son was born on December 28th, and yes we could claim him for the year he was born.
