Would a stimulus check require both signatures if the return was filed jointly?
We filed jointly and are now getting divorced- I have been told that he received the check ( it is suppost to be turned over to our bankruptcy trustee) and has deposited it into a new bank account that he opened for this. He told that person that it is to be held for 14 days. He tells me that he hasnt seen it-
I am going to call the IRS Monday, but I am wondering if he even needed my signature to do that? TIA |

The best number to call is 1-800-829-0582, extension 726. They will be able to tell you if the check has been issued. If it has, and what you were told is true, you can request that the IRS trace the check--although you'll have to wait four weeks from the mailing date to do that. If it's been cashed they'll send you a photocopy of the check. You might also want to contact the trustee. |

Since the IRS issued the Stimulus Check in both your names, the IRS requires both of you to sign the check. I have seen this many times before, it is very likely that your spouse signed your name to the check. In addition, to contacting the IRS, I would also inform you bankruptcy trustee. Hope this helps |

Since you filed jointly, the check would be issued in both your names and would required both your signatures, bank required both of you to be present when cashing the check, regardless if it is being deposited into a joint account. If he forge your signature and deposited into his own bank account (account only in his name) he would have forged your signature. And he just committed fraud.

It will go to whomever's SS# it was based on, or so I was informed.
If he was just depositing in a joint account, then NO he would not need your signature. If you filed electronically, then it would go into the account you filed into originally. |

Both signatures need to be there. Definitely call and report this immediately.
This is why most banks insist on both signatures being on the check as well as the check being deposited to a joint account in both people's names.
Don't worry - if he has a new account and they actually accepted the check without both signatures, the bank is wrong and may have to take a hit on that one. He'll not be in good standing with the bank either.
