Stimulus rebate - will child support take it all or just his part?
my husband owes back support for his oldest child. they took state return and will be taking his part of the federal return. we filed injured spouse for my portion and are waiting on it to process. will child support take the entire rebate check or just part of it? how can i figure how much we will actually get? thanks!

please no comments on how the child deserves it - the mom uses no money for the child and it is a messy situation but child support is being paid right now!

i believe you will get "your" portion if you filed injured spouse. which means your tax liability plus 300 for any child under 17 claimed. it may be delayed though. the government sets its own schedule when it comes to money

It is impossible for anyone here to tell you how much your rebate will be. It depends on how you filled out the injured spouse form. It depends on the state you live in, as state laws vary in this regard. It also depends on what stimulus payment you would have received if you had filed a separate return.

If you want to fill out a separate return for yourself, you could put that information into the calculator at irs.gov. That would be the best guess as to what your rebate might be after the IRS figures out your allocation.

Child support is not meant to be "spent of the child" but rather support the child in any way that helps secure the child's well being. Using the child support to pay for housing, utilities, gas, transportation, etc. is sometimes necessary. It would be ridiculous to allot child support money to purchase fancy clothes and video games if the custodial parent is unable to pay for the necessary 2-3 bedroom apartment, high utility bills, and outrageous transportation costs. As far as back child support, again if the custodial parent supported that child for years on his/her own, who's to say how the money should be spent---whenever I recieve my yearly large sum of child support (tax return--$1200-1400) my ex is now close to $15,000 in back child support--- I try to invest in our house---this year a backyard fence, his stimulus rebate will pay for new carpeting for the children's rooms.

You should call the IRS and make sure...but according to the FAQ page on the IRS website because you filed an injured spouse form and it has been processed you will recieve your portion of the rebate just like you will with your portion of the refund.

The phone number for the IRS is 800-829-1040...press 7 for rebates. Ask them to confirm for you that your injured spouse form has been processed and you will be recieving your portion of your rebate.

A. In this situation, you are considered an injured spouse. To get your share of a joint income-tax refund, as well as your share of the stimulus payment, you can file Form 8379, Injured Spouse Allocation. You will get your share of these payments, and your spouse’s share will be applied to his or her past-due federal or state income taxes or non-tax federal debt such as student loans and child support. Your allocation request will be processed more quickly if you attach Form 8379 to your regular 2007 federal income tax return. [New 3/25/08]

Q. How will the IRS treat a stimulus payment when there is an innocent spouse involved?

A. An innocent spouse determination for a 2007 income tax return would follow the filing of the return. In most instances, the stimulus payment will be issued before such a claim is filed and before a determination can be made. [New 4/14/08]

The rebate payment will be split if you filed injured spouse. It is not allocated as the refund will be.

This is actually in response to all the comments about children needing money....

Of course, children should be supported by their parents. However, step-parents aren't legally obligated to financially support their step-kids.

Its a shame when a parent either won't or is unable to support their own child and then depend on their spouse to pay it for them. I'm also horrified by custodial parents who think that the non-custodial parent is automatically obligated to support the child.

Step-parents have no legal rights toward their step-children. Step-parents can't sue for visitation. Why should a step-parent be burdened with responsibility of financially supporting a child while they are unable to receive any of the benefits of having legal rights to see a child?

Since you filed the injured spouse form for the tax return, it automatically transfers and applies to the stimulus thing to. So they will only send his share of the stimulus payment to his back support, and you will get yours. How they decide what part of the stimulus is your vs. his depends on your incomes.

ALL children deserve to be loved and supported by their parents, particularly the noncustodial parents.

Child support takes your Tax return ,,the stimulus rebate is not a tax return,,it is a separate deal,,its just based of your file

they would have to put and injunction on it, and you would have already got papers saying that they are taking it
