Here’s their situation.
My wife’s sister and her 2 kids just came from the Philippines in late October. She just started working this week.
She is 38 years old and lives with her Dad and the wacko Step mom. She was wondering if she could file her 2 kids next year even though she only worked 1 month.
She was asking us because her step mom is charging her thousands of dollars for the money they spent petitioning her.
She will pay it back, but knowing here stepmom she will pocket the refund and still charge her for petioning her.
Or should the dad and step mom be the ones filing all 3 of them?
They already have their green cards and social security cards.
Do the kids need to be here more than 6 months to qualify for filing?

How long she was employed is never an issue. How much she earned may be. It is possible her dad may not be allowed to claim her. She needs to talk to an attorney that specializes in tax and possibly immigration issues. |

She probably won't get much back because she isn't claiming head of household, and there is no age restrictions on the kids. But it sounds like her best bet will be to let you and your wife claim them. Or get it in writing and signed in front of a notary that the refund the step mom gets back should go towards the money she owes. |

Greetings!
The only thing stood to be gained here is an earned income credit. This is of course contingent upon those kids having social security cards.
The people (not necessarily parents) who affording them 50 per cent or more of their upkeep, are entitiled to claim the children on their taxes. (even when not related).
Thus the so called "wacko" who let them come over here from the Phillipines (of all places) to live off the people of this country, are the ones entitled to the deductions if any.

Yes she can claim for 2006 but it will make no difference. Since she has low income for 2006 she will pay no tax anyway. And the earned income credit will not be allowed because she was not a US taxpayer for the whole year. |
