She is 18 and dependent on us. Husband in Iraq, filed taxes as married filing seperately (divorce in process), says he did not claim her as a dependent. Her taxes were accepted (marked that she was claimed on someone else's as dependent) and took zero exemptions. Then I filed our taxes, with her as daughter and 3 exemptions (husband, self and her). BUT WAS REJECTED. SO WHAT HAPPENED? Did he claim her after all? We really need the money. Any recourse if he claimed her? Any way to find out if he did claim her as dependent? Additional Details I know she qualifies as our dependent for sure. I filed her taxes for her, so I know she didn't claim herself, and I did her taxes before mine. So if she didn't claim herself, then do I have to ASSUME that the creep did? |

Someone has claimed her as a dependent. You can still claim her but you'll have to file a paper return and mail it in. The IRS will then contact both of you to sort out who is legally entitled to claim her. Most likely that will be you. Do respond quickly when the IRS contacts you though or whoever else claimed her may win by default.
Note that if you are filing a separate return you may NOT claim an exemption for your husband, though! That would also cause your return to reject! |

I think the rejection issue is with you claiming your husband as a dependent as well. You can only claim yourself and your child if your husband is filing his own return. |

Any chance he filed a joint return, with her on it? He can't legally do that without her signature, but might have. If so, it could take awhile to sort it all out with the IRS. And no real way to find out - the IRS won't and isn't allowed to tell you who claimed her, but there don't seem to be a lot of other possibilities as long as you are sure she didn't accidentally claim herself on her own return.

You were probably rejected for claiming your husband. Your spouse is never your dependent and if you filed married filing separate you don't get an exemption for him. |

sorry u will not get the 'deduction' for her.
she does not belong to u any more even after the divorce.
she is no longer legally a dependant, unless she is totally disabled in some form.
u
untill the divorce is finalized she belongs to him.
u in NO way can claim Him or Her as dependants.
u need to file new return with u only listed.
anything else is considerd tax fraud. |
