Dave | Tax Error, Can We Go To Jail???? |
My sister prepared my taxes, she put her name down where it says preparer. She isnt a tax preparer or a CPA. Can we get into trouble for this? Will they even notice? She is really scared because someone told her you can do that. We already mailed them so there is no going back |

It's only a minor error and not deliberateso no you wont go to prison just contact the tax office and tell them of your mistake and they will see that you wern't out to fool them |

No worries! She would not need to sign there if you didn't pay her for her services, but signing it will NOT get either of you into any trouble at all, especially if the return was prepared properly.
If there are any problems with the return, the IRS will be coming to you for answers and corrections. They ONLY look at the person who signed as Paid Preparer if they see a pattern of gross errors or outright fraud coming from the same Paid Preparer. Your sis has NOTHING to worry about at all! Not sure where the first two respondents get their information, but they obviously know NOTHING about how taxes work!
FYI, there are no Federal qualifications to be a tax preparer. Virtually anyone can hang out their shingle as a "Tax Preparer" or "Tax Expert." A few states do regulate the industry within their borders but not the IRS. As long as there are no problems with the returns that they prepare, nobody will give them a second look. |

LOL. Sorry to hear of your worry. Maybe in an animated Disney movie they might get in trouble, but worry no more. You signed it, and your sister had the right to help you as your preparer. No "degree" or "license" is required to help somebody with their taxes. Rest easy and enjoy your day. |

No, nobody's going to jail over that. If the return is correct, nobody will even notice or look at that part.
People don't go to jail over mistakes on their taxes, just for serious deliberate fraud. What she did is an "oops" if it's ever questioned, not fraud - and it's very unlikely to be questioned. |

The IRS will likely not even notice. They will only care if the return is riddled with errors or if they want to do a hardcore audit.
Your signature is on the return though, right? That's what matters. It doesnt matter who prepared it. So long as your name is at the top and your signature is at the bottom. And even if you didnt sign your return, all the IRS would do is ask you to sign it. You would get hit with late filing penalty tho.
Your return is reviewed by a computer looking for statistical aberrations. The computer wont give a rat's *** that your sister signed the Preparer's line.
If your return is clean there's nothing to worry about. I dont know why other posters are telling you wou will be fined or similar.
The obvious question I have though and, truthfully, I dont want to know the answer, haha, is if your sister is neither an accountant nor a tax preparer, why is she doing your taxes? Why didnt you do your taxes or go to an accountant? |

The IRS may inquire as to why she did not report any income from tax preparation on HER return. Only a person who charges to prepare a tax return is supposed to sign as preparer. Therefore, the IRS expects that person to report receiving income from preparing taxes. |

No problem. No law broken. In fact, the IRS is happy when a knowledgable person helps a person do taxes. For example, AARP get volunteers to help retired persons with taxes. These volunteers do not need to be CPA, etc.
If she was doing tax returns for hire, then there is often a state license that is required. (there is here is Delaware.) Plus, she would need to register with IRS. The registration is needed in order to e-file returns for other people, and to designate where money can be sent, etc. There is now FBI background check require for this. (I know, I do taxes.) |
