They'll take any 2007 refund and your stimulus payment to cover the defaulted student loan. If there's any left over after the debt is covered, you'll get it.

Since you filed a joint return, the money is due to both of you. ONE of you owes it, so the entire amount will be applied to the outstanding student loan debt. If you want to somehow separate 'your part' of the refund, then you must file separately. |

You can file a Form 8379, Injured Spouse Allocation to protect your share of your tax refund and half of the rebate. Ideally you should file that with your tax return but you CAN file it after the fact as well. You can get the form at the IRS website. |

Dont walk, RUN to the place where you filed and amend your return
you will need to file a form for 'INJURED SPOUSE"
so that you can keep YOUR portion of the refund.
Now of course if this is your husband's debt
I would just let them take the entire thing since in the long run you are going to have to pay it anyway but if you want YOUR portion of the refund file the paperwork above to preserve it.
Keep in mind however the longer he does not pay the more interest he is racking up |

They will take the entire amount. If some of the income and withholding on the return are yours, you can file a form called an injured spouse form, and they'll split it based on how much is due to you and how much to him, and give you your share and just take his. |

If you work or have income, you need to file an injured spouse form. This will give you a refund of taxes based on what you earned and the government will take the taxes based on his earnings...
File the form as soon as possible.
I just learned this today, and am not sure how correct it is, but my understanding is that they will take your refund and sit on it for six months. If you have not filed the form, then they will forward the payment on to the loans place. If they get the form, then they will look at your return and send some to you and some to the loan people. |

They will take what is owed, if it is less than your check you will get the remainder, if it is more they will take the whole thing. Same thing happened to us. |

they will take what she owes and give you the rest, (if anything is left over). Once you are married her debt is your debt too. |

I am in Michigan and have been through this. As long as you fill out an injured spouse form, you will get your share of income tax back. In Michigan and the other states that are not community property, they cannot take your portion of the money since you do not owe the debt. Just because you are married does not mean you owe the debt. its form 8379. |
