Tax Return Rejected?????????????????...
I supported my wife and child for all of 2008 except for a couple of months. We separated but are still married. I was sole source of income for 2008. To get back at me she filed taxes before I had the chance. Is there anything I can do so I can get my taxes back that I deserve since she lied on hers?

I had a similar situation, the boyfriend of one of my foster daughters filed his taxes before I did and claimed the girl and their baby on his return. He had contributed nothing to their support. She moved in with him the middle of January 2004 and the tax year we were filing was 2003.

I filed a dispute. My documentation was the placement paperwork and school record indicating her legal residence (my home address) The IRS reviewed his return and mine, sent him a letter asking for his supporting documentation. He came to me asking what he should do (duh) Eventually he did respond to them.

IRS reviewed the information, mailed me my corrected refund and required him to pay back the money he had fraudulently received.

My advice is to contact the IRS yourself so there is a record of your contacting them. Get the proper documentation required and mail that with a copy of your original return.

You didn't say which state you are in or I would have found the number for you. There are tax offices in each state. I would try a search for the IRS office in the capital of your state.

Most likely you will get a voice menu (they don't really want to talk to every nut out there) do your best to get to a live person. You may be able to press 0 after each selection list, after awhile it should take you to an operator.

If you aren't able to get to a live person, you may want to email our new president and let him know that the IRS is inaccessible <G>

Yes. If you think you can legimately claim them, you file hardcopy (paper) returns doing so. Not an e-file. The IRS will ask both parties to justify their returns.

You need to mail in your return and the IRS will decide who was correct if either. Married filing separately is the worst way to file so if you both do that their might not be a refund. You both need to itemize or take standard and some credits are eliminated.

File a paper return. The IRS will audit both and you will come out victorious if what you say is true. As for what Victor said, all though in most cases this is true, if you still supplied 100% of both of their support for the 2008 tax year, then you trump the physical custody.

E-filing isn't bad at all, ignore the person who said you needed to file a paper return. If anything, e-filing is better because then the IRS won't have to make copies of everything you send in.

Anyway, when did you separate? How did she file her taxes? If filing jointly doesn't seem to be an option and you supported your child (and live with him/her within the last 6 months), you may be eligible to file as Head of Household, which is 2nd best to MfJ.

File one of these ways and you'll just have to fight it out when the IRS contacts you two for having contradictory returns.. that's really the only way to get your money.
