My ex claimed my son on her taxes and wasn't supposed to according to our custody agreement. So my tax return was refused by the IRS because they said that my son's SS# had already been used. I know it was correct because I double checked. My ex swears she didn't claim him but she is a constant liar and suddenly lost her tax returns so she cannot show me. What can I do? |

You can mail in the custody agreement showing that you have psychical custody of the child. The ex will end up audited, as she is not supposed to claim the child unless the child lives with her more then 6 months of the year. |

If the court order that you can claim him has the proper wording to meet IRS rules, then if you send the IRS a copy, you'll get the deduction and hers will be disallowed.
Warning - not all agreements do, and if it doesn't follow the IRS rules, it won't be accepted. For example, and agreement based on child support being current doesn't pass the rules.
Without a properly worded agreement, the parent the child lives with gets the deduction. It has nothing to do with which parent provides the most support.
Give it a try and see - nothing to lose. |

EASY fix. Happens all the time. IRS won't tell you who claimed your son, so you won't know if it's her or not.
BUT you mail in your divorce decree to IRS along with all your info and return. Should have done this right after it happened. Will take a month or so, and you should get your refund and she will have IRS problems if she's the one who improperly claimed son. If child does not provide more than half his own support and you've paid your child support, no problem for you claiming him according to decreee, and you DON'T need physical custody like LL claims above.
The first to file gets their refund quickly, so file before her next time. Then when a second return claims same dependent, that one gets stopped, and if they pursue it, both returns are examined and additional info required. |

This happens every day so it is no big deal. Having your dependent's SSN used by somebody else, just keeps you from electronically filing. Just file your return via paper and attach the divorce decree that specifies that you get the dependency. They will process it and send you your refund and send your ex a bill so she can repay the extra refund she got by taking the dependent. If she doesn't pay, they will hold it back from her next refund next year.
If you have already filed and had to not take your dependent, you can do the same by filing an amended return (Form 1040-X) to change the already filed return.
If you want to avoid this hassle next year, try to electronically file before she does. As you learned this year, the first one to file wins - at least temporarily - and the last one to file loses and gets all the hassles. |

File a paper return claiming your son as a dependent. Send along the custody agreement and any other information that supports your right to claim the child. It may take several weeks but at some point the IRS will make a determination. At that point, should they agree with you, you will get the benefit of an extra exemption and she will get a bill. She may have additional difficulties if she also got EIC for the child. |

You can mail in your tax return with the proof that you can take the exemption. You cannot efile. The IRS WILL investigate and your ex will be penalized. |

Hopefully, you haven't efiled without the child. Just print out the valid return and send it in. The tax return will be processed as normal and will automatically trigger the audit process. You (and the person who claimed the child) will receive a letter stating that somebody made a mistake and the one in error should file a 1040X. If that person doesn't, then you are asked to supply proof that you met the tests.
If you *have* efiled, then you need to amend with a form 1040X. The 1040X is VERY slow. It's doable, but not the preferred method. |

The IRS says that dependency of a child is based on economic contribution and if your Ex can prove she supplies more that 50% of the children's support, then under the laws she gets the exemption. Courts can not deny a legal right |
