if youre married you shouldn't do that. But if he is just your boyfriend and you don't live together both file as HOH but I dont think 2 people can claim HOH of one house. I think you should claim HOH and get EIC you will get more money that way. Anyway you can go to turbotax.com and check both ways to see who gets the most money it doesnt file until you press file and you can change anything you want. Hope this helps you |

You can claim one child and he can claim the child that is his child. If you live together, only one of you can file as head of household. That should be the person who pays more of the expenses.
Work your taxes both ways and see. It may be possible to get more money doing what you suggest, or not. If depends on your incomes. |

If so, you can only file married filing joint or married filing separate....
if not....do you live together?
If you are the true head of household lived alone and sole provider for 2 kids you should again file that way..it is the lowest rate.....
Figure it both ways to see which is better, but you cannot file head of household if you are married to him! |

If you live together, then only one of you can file as head of household. One of the requirements for hoh is that you provided over half of the cost of maintaining the household for the year - you can't BOTH have paid OVER half of the household costs. The one who doesn't file as hoh, probably the one who makes the least money, would file as single. |

My husband and I used to file Him, head of household with one dependent, and me single with one dependent, that was before we got married. You can go to H&R block's website and use there caculator to estimate how much you'll get back. When I used it it was right on the mark this year. (I've already filed) using that caculator is free.. and you can try it every different way to estimate what you'll get. |

Only one person can be head of household though. If your married, you should be filing together. Either way, you will be getting the same amount. It would be different if you had 3 children. 3 child is tax credit only. first 2 help with taxes. My finance is an accountant.
Just keep them both...it will come out to the same thing anyway. |

Be very careful with your filing status.
Assuming you plan to do your own taxes, I'd place a call to the IRS and document who you talk with, the date, the time, your specific question, and their answer. Armed with this, your are much less likely to incur any financial penalties for a mistake.
If you are living as a married couple (I did NOT say married), then neither of you qualify to file as head of household. If you maintain two separate households, then at least one of you probably qualifies to file as head of household. Legal custody generally determines who can claim the child as a dependent but specific stipulations in divorce settlements can modify this. The addition of SSNs for dependents makes tracking of this very easy - and it is tracked. Make sure you comply with any and all legal stipulations for claiming dependents.
Being a blood relative is not necessarily part of the dependency test - paying more than 50% of the day to day living costs of a dependent is.
Having said all that, if at least one of the children used to qualify for filing as head of household is actually a member of your guy's separate household and he meets all the dependent requirements listed, then that qualifies him as head of household. Same goes for you. |
