me and my gf arent married and we have a kid, who would get back more by claiming her, i make 25,000 yr and she makes about 3000 yr and would be filed as single parent

I think you would. File as Head of household. that gives you 7,850 standard deduction, 6,800 in exemptions (3,400 from you and 3400 from your child) 1,000 in child tax credit. Bringing your tax liability to 9,350 Tax on that should be around 900. So take whatever with holding you paid in subtract 900 from it. Then add about 1,120 from the EIC. That is roughly what you will be getting.

If you let her claim the kid she doesn't need anything to reduce her tax liability. Just filing single and 1 exemption gives her over 8k of reduction. Making 5k pointless... That with out claiming the kid. So the extra money from Head of Household, child tax credit and an extra exemption all goes to waste. FYI her EIC would only be around 1,020. So you'd even lose $100 dollars right there.

**EIC is a refundable credit which means money in your pocket. All the other mention credits/deductions/exemptions just lower your tax liability once you hit zero you get nothing extra back.

So hands down you should claim her. this was just an estimate also. There might be other credits your entitled to.

Also you could probably claim her on your taxes. Give you a couple good hundreds more.

If you live under the same roof then by law only you, as the higher wage earner, can claim the child as head of household. Your gf should file as single to obtain a refund of taxes withheld only; and not take her dependency. That way you can file as head of household, take both as dependents, and claim the EIC & CTC for the child. If you want study the situation yourself go to IRS.GOV and get a Pub 17 which has the flow charts and printed matter pertaining to your situation. I just condensed 36 years of training and hands on experience down to a few words that cover your situation.

You would get more from claiming her. There isn't a filing status of "single parent" - she'd have to file as single since on $3000 she can't claim to pay over half of the expenses of keeping up the household. If you all live together, and don't live with someone else who is substantially supporting you, then you can file as head of household if you claim the baby. You'd also get benefit from the exemption and child tax credit, but your gf's income is too low for her to get any benefit from claiming the baby. And finally, either of you would qualify for EIC if you claim the baby, but you would get a higher amount than she would.

One more thing. If you and your girlfriend lived together ALL year, her income was under $3400, you provided over half of her total support for the year, and your relationship doesn't violate any state or local law or ordinance (even if it's not enforced it still counts here) then you can very likely claim your gf also as a dependent.

If you lived together all year you may well be able to claim both her and the child. And if you claim the child you can file as Head of Household and claim the EIC as well.

Her income is low enough that if you provided more than half of her support, lived together all year, and your relationship isn't illegal under local law, you can claim your g/f as a dependent. Her income is low enough that she won't have a tax liability so she'd only need to file to have any taxes withheld refunded to her.

It would act as a bigger deduction for you. The question has some many other unanswered questions inside. I think the best way to answer it is that it would impact your taxes more with more income and you probably had more taxes taken out. As for the how to move forward if you aren't going to get married you may look at alternating years that you claim your child.

If she makes, $3000.00, It would probably be best for her to claim the Child (not "Kid"). Why not test it both ways, tho, to see which is the best way ?
BTW, Please get married for the childs sake

Are you living as man and wife? For 10 years before we actually perfomed "the ceremony", we always filed as husband and wife, even though she had a different last name. That being said, we always had joint bank accounts, the house was in both our names, etc.
