I read your other question also, its better to put this all in one question. If you have a joint account they can come after that, they can come after your income tax refunds, when you file jointly. You can file separately, but the tax consequences are worse than filing as a single (you don't just get 50% of what you would if you filed as married). & No you don't have to change your name, but that doesn't affect how they view joint assets.
Truthfully, from the way it sounds, you would be better off just living together & not getting married. I mean, marriage is about the feelings between two people & not a piece of paper certified by the government. If you want a ceremony, have that & forget the marriage license. It just causes more financial headache if he has debts like that, and if you divorce him, he could end up better in the end...his money going to pay for past mistakes & your money going to accumulate things for your marriage & he would walk away with half. Especially if he accumulated debt while married to take care of those obligations, you could end up responsible for half that debt.
The only thing a marriage helps with is medical insurance will cover your spouse, and if someone dies without a will, then their assets would go to that spouse.
Think carefully if you really want to be married. |

No you don't have to change your name when you are married.
You can file a joint tax return (almost surely less tax overall between you that way) or file as married filing separately. You are not allowed to file as single. In any case, use the same name on your tax return as is on your social security card. |

You do NOT have to change your name when you get married. You can file Married Filing Jointly or Married Filing Separately regardless of whether you change your name or not. Married Filing Jointly will usually result in the lowest over all tax. |

I missed your original question, but no you do not have to change your name. You must file taxes under whatever name is on your social security card.
You can file taxes in the married filing separately status, but you lose a lot of the tax credits, etc., it is always financially beneficial if you file married.
OK, found your original. File married, then include with it an injured spouse form. The IRS will only keep the portion of the return that would have been his. DO NOT file married filing separtely. If you do you will lose the ability to claim many credits, etc., that you would otherwise be eligible to claim.
If you plan to do your own taxes, the IRS's web site has the form you will need. It is not a complicated form. If you go to a professional, they can do it all for you. |

As a woman, you do not have to change your name after you are married. That is a choice for you to decide. For tax purposes though, you'll may want to file together because you are taxed at a lesser rate married filing jointly than if your married filing separately.
