He has been the sole support for his 2 nephews , they have lived with him for almost 2 years and he pays all the bills.He only had his name on their school paperwork for 5 months of the 07 year but they stayed with him ALL year long. He is having trouble getting all the documents the IRS is asking for. What can he do? He is a real good guy. He is very timid and gentle and is the type person that would rather pay the IRS money that he doesn't owe than have a confrontation. I want to help him get what he needs but I don't know where to start. I called Tax Masters and they said they would charge more than he would lose to the IRS. It makes me so mad because there are people that cheat and so many that get money back that don't need it. This guy needs it badly and can't afford to fight for his rights. He has never cheated anyone out of anything.Please help me help him! Anyone know much about tax law out there? |

He can establish that the children lived with him the last five months of the year. What about the summer? If he was working, where were the children? Did he enroll them in summer camp? Did he pay someone to watch them?
He only needs to show that they lived there a little more than one more month, so I would concentrate on who watched the children in the summer before school started. Get statements from them. |

About his only choice is to find the kind of paperwork they want to see: school records with the kid's names and his address, doctor's records that same, etc. He has some running around to do but it is worth it to keep that Head of Household status.
He probably got notified via a CP-??? notification. He should call the phone number on it and ask for the person assigned to that CP to ask them exactly what they need, in other words, how little does he have to come up with. The IRS is not unreasonable, but there is so much fraud in this area, they are just wanting him to show that they did live with over half of the year. |

The issue is proving that the nephews lived with him for more than half of the year and that he paid more than half of the cost of keeping up the house. You /He should seek any record that shows that. Medical records, mail they may have received, statements from their parents, statements from neighbors or any other interaction the children may have had that shows they lived at your friends home. If their parents lived someplace else and he can point out that they could not have been in there present school if they were with the parents. If he had any interaction with any type social agency or church you may be able to get records or statements supporting his claim. |

Proving head of household filing status for other than your children who live with you is very fact driven. He needs to produce documentation, documentation, documentation. This is the IRS publication that covers dependents.

He does not need a tax attorney or a tax resoulution service; both are way too expensive. If he were my client, I would probably charge fees somewhere between $250 to $500 to handle the audit. If he can't get it together by himself, he should consult a professional tax practitioner. As an enrolled agent myself, I would recommend one of my counterparts in your neighborhood. |

Have him contact the taxpayer advocate service. They are an independent office within the IRS set up to help taxpayers. He will be assigned an agent that will help him. |

He should contact the IRS to determine exactly what they are requiring and to ask if other documentation is acceptable. If his nephews are living with him, what are the circumstances that made them move in with him? Is there documentation?
If the parents are ill, provide documentation from the hospital.
If the parents are in jail, then produce appropriate documents that prove something like - the parents went to jail in October 2006. Then provide written testimoney that the kids lived with grandparents for November 2006 and moved in with uncle in December 2006.
Or if the parents passed away, provide death certificates.
Or if the kids were taken away by the court, provide those papers.
Can the parents, grandparents or other relatives verify that they lived with him all year? Can neighbors write testamonials that the kids were there all year? If the kids were in school last year, can the former school verify they lived with him - or he dropped them off every morning or something? |

My first question to you...who else is trying to claim the children. Generally speaking, the IRS will not make you prove support until someone else tries to claim or if you are being audited. From experience, I had to prove the grandmother had custody instead of the mother - they both claimed the child. The grandmother won because she had court papers stating custody.
First call the number on your notice or 1-800-829-1040. Ask for help. They will tell you what you need...from experience, you could ask your pastor for a letter stating the attendance for the year of question, medical records, neighbors, etc. |

IRS is not saying he is cheating, he just needs to show the proof they are requesting and if he is the sole supporter then it shouldn't be a problem.
Maybe there is more to it than you were told. |

The IRS would know better than anyone else, what the LEGAL qualifications are. If they are making that claim, there is a good chance they are correct. |

As others have pointed out, there is so much fraud in this area (in addition to HOH, your friend probably appeared eligible for EIC as well) that the IRS almost always asks for proof the first year. It wouldn't surprise me if the IRS asks every year--though once he satisifes the IRS, he can point to that year.
Given that these are nephews, your friend may have to a) forgo fighting for the extra refund for 2007 and b) start building a document file for 2008. |

What he can do is claim all that he has paid into the system as gifts for his nephews and itemize. Unless he has legal documentation stating that he is their sole guardian he is limited to resources. There is always a loophole. |

He should see a lawyer that specializes in taxes. Some offer free consultations. Check you local listings in the yellow pagers.
From there he should be able to get some direction as to what he needs to do. Best of luck to this fine person for taking care of this nephews. |
