The IRS sent me an official letter saying I owe taxes from 05 and 06 and the reason is CRAZY!?
OK, so I get a letter from the IRS saying they need information on my dependents. I sent them all the crazy stuff they asked for, "proving" my children were mine! Birth certificates, school records. It was the craziest thing I had ever heard of! But, I did it. Now I get a new certified letter saying I owe $5,000 for 05 and $5,000 for 06 because they determined the kids were not mine and did not live with me?!?!? What the f^@k! I mean come on! How in the world do I fight the IRS on this? I birthed the darn kids! And there is no where for this to come from. I have always had full custody of my kids. Very odd. How do I fight this now though? I don't have a clue on what to do?

No one else is "legally" allowed to claim them but me. Their dad didn't claim them, we even double checked his returns to make sure.

You do NOT need a tax attorney to go to tax court, you can write the petition and handle it yourself. There is a $60 (I think) filing fee, but it may be worth it to clean this up.

I know if you are lucky enough to have Philadelphia as your local tax court, the law department in the colleges close by will help for free. And I'm sure that no matter what tax court you petition, that help is there also.

But try the Taxpayer Advocate's office first. It is free and may be helpful. And don't be afraid to call your elected officials, it is what they are there for.

First, Calm DOWN.

Contact the Taxpayer Advocates's office (you can find the phone number at www.irs.gov).

DO NOT file a 911 form, this is not an emergency and you are wasting resources. You do not need a lawyer and you MOST definitely do not need some spammed supposed tax office run by IRS types as the post above suggested.

You can get this resolved, but it will take patience and a better attitude then you seem to have right now.

I'd call the taxpayer advocate at 1-877-777-4778 and see if they can help you. If not, you might just have to bite the bullet, hire a tax attorney, and file an appeal in tax court. Be sure to meet any deadlines mentioned in the letters, or you give up your right to appeal.

Contact the IRS "ombudsman". They are supposed to help in these types of situations. Be nice. NEVER be snippy with the IRS. Vomit afterwards if necessary, but "don't spit where you eat".

Is it possible you are being targeted by a political enemy?

Is it possible you received money you did not pay in, as in EIC, and perhaps it was not calculated properly, so you need to pay back a refunded amount that was not legally due to you. That is different than saying you owe because they are not your dependents.

First, if you have no success with the contact number on your letters, try the taxpayer advocate. Fill out Form 911 (intentional reference) http://www.irs.gov/pub/irs-pdf/f911.pdf

They have broad authority.

It sounds like somebody else declared the kids on their return.

If the kids showed up on two separate returns, it'll raise flags.

Does that sound possible? Would somebody else think they could claim your kids, perhaps an ex-husband?

Let's see, you made like $10,000 and you are saying that on less than $1000 a month, you supported not only yourself, but 2 children. At $10,000 of income, you would qualify for over $4000 of EIC.

The IRS isn't questioning that you gave birth to the children (the birth certificates were enough to prove that), but rather that the children didn't support themselves (presumably neither had a job) and that you can prove they lived with you for more than 6 months of each of those years and thus meet the requirements to claim EIC.

In addition to school records (which doesn't always show enough time), you could also produce medical records, social work records (on very low pay, you would could have qualified for food stamps and housing assistance and these records would show if you were claiming children--and the IRS probably has access to those records and would know if you DIDN'T claim your children), the rental lease where you lived showing that they lived with you, affidavits of landlords and neighbors that they children were living with you, etc. If you did not present all of your evidence, get it. Submit that for audit reconsideration.

There is also a chance that the another parent or relative also claimed the children for EIC purposes. The IRS would ask them for the same proof. If they have overlapping claims, the IRS would have to decide whose proof was more truthful or if equally valid, use tie-breakers.

This is SERIOUS. If you are found to have fraudulently claimed the children when they were living with someone else, you will be banned from the EIC program for 2 or 10 MORE years.

Okay, so now you made $50,000 so it's not an issue of EIC. How about other credits such as education?

If these are college age students, did you have carefully fill out the support test worksheet? If the children had good jobs and loans to pay for college, they may have supported themselves which leaves you ineligible to claim them.

first of all you shouldn't not say "darned kids". second with you language makes me wonder what type of mom you are.

Simple answer your children were claimed by someone else, even if your ex say he didn't more than likely he did. You should not be upset about this you should investigate who is claiming and got credit for the children.
You should be nervous speaking with the government, if you have nothing to hide, they are just doing their job. Don't go blaming others because of mistake done in your part or husband part.
Have you verified that the social security number listed on tax return for the children is correct?
Relax no need to lose your mind over this, stress is not a good thing, especially with caring for your children.
You are a somebody! you are the mother of your children, whom will need you now and later.
And don't call IRS yelling and cursing it doesn't do any good but put an alert on your account.

Did the IRS letter state exactly why they did not accept your documentation? They normally do.

Something triggered this audit. Normally it's because someone else claimed the children and the IRS is forced to determine who is entitled to claim them.

Obviously someone else is trying to claim them. You may need an attorney who knows how to deal with the IRS.

I agree with the first Answerer, you need an Attorney! Before that though, you need to call the IRS and talk with whoever is handling your case. See if you can find out who else is trying to claim custody. And call Tax Masters 1 800 581 0457, its a law office with former IRS agents who work to help people in your situation. Best of Luck!!!!
