I know I shouldn't have given him a second chance when I didn't receive my return from the year before. But, he said he would give it to me when I went to his office with last years return. Anyhoo, everytime I ask he gives me some song and dance and I have yet to see my returns!! I think he fraudently did them because I got back a lot more than I should have. I'm thinking he won't give them back because I got an even bigger return than what he gave me and kept some of the money. What can I do? If he prepared your taxes, either his social or his PTIN (preparer tax id number) will be on the return. You may want to contact the IRS to see if they can look up the info on your previous return and get that info. Also, you can go to a more reputable tax preparer (skip the H&R blocks and Jackson Hewletts). It may cost you a little bit more money, but that new tax preparer can contact the guy on your behalf and request that info. A new, more experienced tax preparer may have a better time dealing with the guy than you do right now. Your new tax preparer can also go over your tax returns from the last 2 years to make sure that they were done correctly. If they were not, you can do an amendment and hopefully, you don't have to pay back any money that was given to you in error. Hope this helps. Don't be afraid to contact the IRS if you have to. |

The IRS also has copies and keeps up to 5 years I believe. You can request them straight from the IRS. |

Call the IRS. The computer transcript for the last years is available and it will tell you what was claimed on the return. They can also tell you what the amount of money was that was refunded.
If the returns are fraudulent, the IRS has up to 6 years to audit you. If a preparer puts together many bad returns, the IRS will start looking at all of the returns filed by that preparer.
However, if you use a preparer and you don't pay your fees up front, the preparer often gets paid out of the refund. This is legit.
Refunds CAN go to the preparer. It's a form of refund anticipation loan. The refund goes to the bank, the bank pays the preparer and the preparer will often a check to the taxpayer. The taxpayer has to agree to this up front, but if you don't pay your preparer up front, you must realize they expect to get paid..... |

Contact IRS at 1-800-829-1040 and let them know about this guy, did he actually mail the return to the IRS for you? did you sign the return?
If the returns were filed and you were due a refund, did you get the refunds. Let the customer service representative know all this information when you call, IRS will then investigate the issue.
Be patient could be a lengthy process. |

Remind him it is a federal offense .
Tell him unless he wants to spend a few years in the federal pen to cough up the returns or your calling the IRS.
Also call the IRS if he has cashed any of the checks ? Then he has alot of trouble coming. |

Is he a CPA? If he is, then he's licensed by your state and you can file a complaint with the state board.
Actually, if he's NOT a CPA, but identified himself as a CPA or as a public accountant, the state board may still investigate a complaint.
You can also get a "transcript" of your tax return from the IRS at the link below . . . That should help you figure out what he's trying to hide. If it's a tax-form issue (like he isn't signing the forms as the tax preparer), you may be able to report him to the IRS. |
