You will need to find those files and re-report them. I trust he saved copies. If not, he'll have to go back to former employers to get the info. If you cannot provide proof then you are both stuck with it. |

He'll have to file those two years, or provide proof that he already did. That's why you're supposed to keep that stuff. |

Bad News: He has to refile or provide copies of his returns for that year. If he does not have proof that he filed, and he was owed a refund that he never received, he probably won't get the refund. If he owes taxes, he probably owes interest and penalties also.
Good News: If he owes less than the IRS took, then you should be able to get that back based on the amount deducted from your refund. If he has documented proof that the IRS received the returns (i.e. return receipt or IRS stamp on his copies), then he may be able to get any refund that would have been due.
If he had to pay taxes with the return, and he has a copy of the cancelled check for the taxes, this may be provided as evidence that he filed timely. Ask the IRS for its records showing receipt of the check, and the manner in which it was received. This puts the burden of proof back on them, and MAY keep him from paying penalties and interest.

So, what is your question? People are supposed to keep at least the last 3 years of
their income tax records. It's the law! I have kept 40 years worth. If he has done nothing wrong, he can show them the records. If he has no proof, he's probably guilty and you can expect an audit in the future as punishment.

OK, your husband is stuck and must file or re-file. I'm betting he didn't and isn't admitting he was such a schmuck. If he filed, he should have copies. Can't really believe IRS lost 2 years returns. And now they've figured his taxes for him based on W-2s, and not in the most favorable way, either.
BUT for YOU, you need to file an injured spouse allocation, and the IRS should release at least part of your refund to you. So get that filed, and wait for the check.
Secondly make that man get those old taxes filed NOW. If he's due a refund, the IRS only pays back 3 years, and the deadline is 4/15. If he owes, they go back further, of course. Get this straightened out, because it will be a black cloud hovering over your lives until it's resolved. Ignoring it didn't make problem go away, did it, hubby? |

does he have any proof he filed? if so then he needs to present the paperwork to IRS, also did you work in year of 2007 if you did then get a injured spouse form and file it to see if you can get money you paid in taxes back.

If your husband saved copies of his tax returns, which he should have, and has the documentation, he needs to take it all to the IRS. If he does owe money, and you have a substantial income, file separately. |

Either your husband did not file, he mailed the returns and they were lost in the mail or IRS lost them. In any case, IRS has no record of receiving them and that is the problem you have to deal with.
Reading between the lines, it sounds like IRS has made a substitute for return assessment. Briefly explained, this means IRS filed a return for him. He can get the details by requesting a transcript and, if he feels the tax is incorrect when he files a correct return, IRS will adjust the amount due and issue a refund if it is appropriate.
If he acknowledges there was money due on the original returns AND he sent a check, coding on the check endorsement will help track where the return went. |
