There is no "probate tax" in the US. Estates over a certain value may pay estate taxes, however the exclusion for 2010 is unlimited so there is effectively no Federal estate tax for 2010. Some states do collect estate taxes that may or may not be tied to the Federal estate tax and others collect inheritance taxes.
