jibs | Unpaid council tax bailiffs coming 2? |
To all the people that aswered my first question regarding my friends unpaid council tax and that the bailiffs are to talk to her regarding a payment plan which has to be done in person. My friend now lives with her mother and father and has no possesions at that property the council tax arears was for another property. So what will they do if they can't list any items? Will they just fill out the payment plan?

peachschnapreturns - The council have not been helpful about this it is for only £800 incl bailiffs fee's and my friend Sam already offered to pay the coucil £100 a month to pay debt off but they said was not acceptable and would cont. with court action and bailiffs regardless, she has 2 children and preg with 3rd and wants to sort prob. out asap but they haven't done attachement of earning or anything like that! |

If the bailiif cant list goods then he may arrange a payment plan , alternatively he may return it to the Council if he deems he can't get an arrangement.
Usualy the Attachment of Earnings route has been explored prior to bailiff action as has Attachment of benefits.
If an account is returned then the Council may accept an offer or it may push for a committal hearing - it all depends on the individual council and how much is owed. |

they would usually go for an AEO - attachment of earnings order. But have they looked into if they are liable to pay? Single people ususally pay less. |

Yes. the bailiffs cant list any property not belonging to your friend.
They could give the debt back to the council and let the council take her to court again. But its better to come to some agreement now. |

hmm the bailiff will list property in your friends parents house and then it up to you to prove who it belongs too.
however, i think most bailiffs will be aware that it is the parents house.
they will get her to complete a payment plan, fill out a standing order or direct debit form and go away happy. |

I would go to the CAB office for advice asap.
c/tax was outstanding on a property that your friend used to live in she will still have to pay it regardless where she is living now They can not take away any thing that is not belonging to her.The council will not help as it has been passed to bailiffs.
I cant see how this has got this far normally you have to go to court and state what you can afford to pay off, if you do not keep to that then attachment of earning is sent out .
Do get some legal advice. |
